b.Develop and implement a policy to ensure that EU and EU MS support to military, police, border control and other security forces, including in the context of CSDP missions and operations, is in compliance with/contributes to the promotion, protection and enforcement of international human rights and international humanitarian law, and is consistent with the EU's human rights policies (Human Rights Due Diligence Policy).

whereas, despite accepting 182 of the 227 recommendations put forward by the UN Human Rights Council at its June 2014 periodic review, Vietnam rejected recommendations such as the release of political prisoners and people detained without charge or trial, legal reform to end political imprisonment, the creation of an independent national human rights institution and other steps aimed at promoting public participation; whereas, however, Vietnam has recently allowed international human rights groups to meet with representatives of the opposition and government officials for the first time since the end of the Vietnam War.

32. Condemns the ongoing attacks on religious minorities, and the harassment and intimidation of human rights defenders, lawyers and journalists; acknowledges the progress made in reconstruction and the implementation of some of the recommendations made by the Lessons Learnt and Reconciliation Commission, but regrets the fact that the Government of Sri Lanka continues to fail to provide for independent, credible investigations into past violations of international human rights and humanitarian law; strongly supports the recommendation by the UN High Commissioner for Human Rights to establish an independent international inquiry mechanism which would contribute to establishing the truth if domestic inquiry mechanisms fail;
32. condamne les agressions permanentes contre les minorités religieuses, ainsi que le harcèlement et l'intimidation des défenseurs des droits de l'homme, des avocats et des journalistes; reconnaît les progrès accomplis dans la reconstruction du pays et dans la mise en œuvre de certaines des recommandations émises par la commission «Enseignements du passé et réconciliation», mais déplore que le gouvernement du Sri Lanka n'ait toujours pas diligenté d'enquêtes indépendantes et crédibles sur les violations des droits de l'homme et du droit humanitaire international commises dans le passé; approuve résolument la recommandation de la Haute-Commissaire aux droits de l'homme de créer un mécanisme d'enquête international indépendant qui pourrait contribuer à établir la vérité si les mécanismes d'enquête nationaux échouent à le faire;

45. Is concerned at the resurgence of violence in Jonglei state in South Sudan, which is jeopardising the progress made on re-establishing peace and security in the region; supports the investigation requested by UNMISS, and calls for those responsible for the violence to be punished; calls on the Government of South Sudan to: (i) take the necessary steps to strengthen its international and national human rights framework, including by reconfirming its obligations under the international human rights treaties to which Sudan was party at the time of South Sudan’s independence, while withdrawing any reservations to them, and becoming party, without reservations, to other key international human rights treaties; (ii) immediately swear in members of the Investigation Committee into the Jonglei State Crisis and provide them with the necessary resources to carry out an independent, full and impartial investigation; (iii) immediately impose an official moratorium on executions with a view to abolishing the death penalty, and commute all death sentences to imprisonment; stresses the importance of the EU’s continuous assistance to South Sudan with a view to providing capacity-building for the country’s public administration and law enforcement authorities, creating and sustaining an effective civil society and promoting good governance; urges the EU to press for the ratification of key international human rights treaties by South Sudan and assist the country’s authorities in their implementation; condemns the reported abuses against civilians by the military forces in the demilitarisation process, and calls on the South Sudanese Government to conduct an independent investigation into the events in order to hold the soldiers involved accountable and ensure reparations for the victims;
45. s'inquiète de la résurgence des violences dans l'État de Jonglei au Soudan du Sud, violences qui menacent les avancées réalisées dans le rétablissement de la paix et de la sécurité dans la région; soutient l'enquête demandée par la Minuss et réclame des sanctions contre les auteurs de violences; invite le gouvernement du Soudan du Sud: i) à prendre les mesures nécessaires pour renforcer son cadre national et international en matière de droits de l'homme, notamment en confirmant à nouveau ses obligations au titre des traités internationaux relatifs aux droits de l'homme auxquels le Soudan était partie au moment de l'indépendance du Soudan du Sud, en renonçant aux réserves exprimées vis-à-vis de ces traités et en devenant partie, sans réserve, à tous les autres traités internationaux majeurs en matière de droits de l'homme; ii) à procéder immédiatement à la prestation de serment des membres de la commission d'enquête sur la crise dans l'État de Jonglei et à leur donner les moyens nécessaires pour mener une enquête indépendante, complète et impartiale; iii) à imposer immédiatement un moratoire officiel sur les exécutions dans la perspective de l'abolition de la peine de mort et à commuer toutes les peines de mort en peines de prison; insiste sur l'importance du maintien de l'aide de l'Union européenne au Soudan du Sud, afin de renforcer les capacités de l'administration publique et des autorités répressives du pays, de créer et de préserver une société civile efficace et de promouvoir la bonne gouvernance; demande instamment que l'Union européenne fasse pression sur le Soudan du Sud pour qu'il ratifie les principaux traités internationaux en matière de droits de l'homme et aide les autorités du pays à mettre ces traités en œuvre; condamne les abus qui auraient été commis par les forces armées dans le cadre du processus de démilitarisation et demande au gouvernement sud-soudanais de mener une enquête indépendante sur ces événements afin de placer les soldats ...

10. Welcomes the presentation by the independent, international Commission of Inquiry on Libya, pursuant to the outcome of the 15th special session, of its first report at the UNHRC on September 2011; supports the extension of its mandate and looks forward to the final written report, to be presented at the 19th session; encourages the implementation of the recommendations made by the Commission of Inquiry and strongly supports its call for exhaustive, impartial and public investigations to be conducted into all alleged violations of international human rights law and international humanitarian law during the conflict, regardless of who committed them, with full respect for judicial guarantees; considers that the human rights situation in Libya remains an area of concern, notably regarding the conditions of detention and the treatment of detainees held by various militias without effective control by the Interim Government over these brigades, and requires increased vigilance and sustained assistance by the international community, as stated by the High Commissioner for Human Rights before the UN Security Council on 25 January 2012;

Therefore, whilst supporting the fight against terrorism, the rapporteur considers that many of the characteristics of the military commissions in their current form actually render them unjust: firstly, because they do not constitute independent or impartial tribunals; secondly, because they do not offer enough process guarantees such as those provided under the US Constitution (and in particular the US Uniform Code of Military Justice), the International Covenant on Civil and Political Rights and other international human rights standards; thirdly, because there are unacceptable restrictions on the right to counsel and the ability to conduct an effective defence; finally, because they imply an unacceptable extension of military jurisdiction over non-military criminal conduct.
Ainsi, tout en soutenant la lutte contre le terrorisme, votre rapporteur estime que de nombreuses caractéristiques des tribunaux militaires les rendent injustes dans leur forme actuelle. Premièrement, ils ne constituent pas des tribunaux indépendants ou impartiaux.
