6. EBA shall develop draft regulatory technical standards specifying the framework for cooperation, and for the exchange of information, between the competent authorities of the home Member State and of the host Member State in accordance with this Title and to monitor compliance with the provisions of national law transposing Titles III and IV. The draft regulatory technical standards shall specify the method, means and details of cooperation in the supervision of payment institutions operating on a cross-border basis and, in particular, the scope and treatment of information to be exchanged, to ensure consistent and efficient supervision of payment institutions exercising cross-border provision of payment services.
6. L’ABE élabore des projets de normes techniques de réglementation précisant le cadre de la coopération et de l’échange d’informations entre les autorités compétentes de l’État membre d’origine et les autorités compétentes de l’État membre d’accueil conformément au présent titre et le cadre permettant de vérifier le respect des dispositions de droit national transposant les titres III et IV. Ces projets de normes techniques de réglementation précisent la méthode, les moyens et les modalités détaillées applicables à la surveillance des établissements de paiement exerçant leurs activités sur une base transfrontalière, et en particulier le périmètre et le traitement des informations à échanger, afin de garantir une surveillance cohérente et efficace des établissements de paiement qui fournissent des services de paiement sur une base transfrontalière.

Where Union credit institutions and financial institutions have branches and subsidiaries located in third countries in which the requirements in that area are less strict than those of the Member State, they should, in order to avoid the application of very different standards within the institution or group of institutions, apply to those branches and subsidiaries Union standards or notify the competent authorities of the home Member State if the application of such standards is not possible.

4. Without prejudice to the powers of the Commission pursuant to Article 258 TFEU, where a competent authority does not comply with the decision of the Authority referred to in paragraph 3 within the period laid down in that decision, the Authority may, where the relevant requirements laid down in the legislative acts referred to in Article 1(2) including in regulatory technical standards and implementing technical standards adopted in accordance with those acts are directly applicable to financial institutions, adopt an individual decision addressed to a financial institution requiring the necessary action to comply with its obligations under that legislation, including the cessation of any practice.

Sans préjudice des compétences dévolues à la Commission au titre de l’article 258 du traité sur le fonctionnement de l’Union européenne, si une autorité compétente ne se conforme pas à la décision de l’Autorité visée au paragraphe 3 dans le délai imparti par ladite décision, l’Autorité peut, lorsque les exigences concernées figurant dans les actes législatifs visés à l’article 1er, paragraphe 2, y compris les normes techniques de réglementation et d’exécution adoptées conformément auxdits actes, sont directement applicables aux établissements financiers, adopter à l’égard d’un établissement financier une décision individuelle lui imposant de prendre les mesures nécessaires pour respecter les obligations qui lui incombent en vertu de ladite législation, notamment la cessation d’une pratique.

Those technical standards should allow the competent authorities to permit financial institutions to develop different approaches based on their experience and specificities, in accordance with the requirements laid down in Directive 2006/48/EC and Directive 2006/49/EC of the European Parliament and of the Council of 14 June 2006 on the capital adequacy of investment firms and credit institutions and subject to the requirements of the relevant technical standards.
