Clause 2: Existing text of section 13: 13 (1) Despite section 11, no person shall use or divert boundary waters by removing water from the boundary waters and taking it outside the water basin in which the boundary waters are located (2) For the purpose of subsection (1) and the application of the treaty, removing water from boundary waters and taking it outside the water basin in which the boundary waters are located is deemed, given the cumulative effect of removals of boundary waters outside their water basins, to affect the natural level or flow of the boundary waters on the other side of the international boundary (3) Subsection (1) applies only in respect of the water basins described in the regulations (4) Subsection (1) does not apply in respect of the exceptions specified in the regulations.

Believes that it is important to encourage research and innovation in connection with water and that the development of European clusters in this area must be supported; calls on the Commission, the Member States and other relevant stakeholders to support the European Innovation Partnership on Water as an effective instrument to concentrate efforts on world-leading research and innovation and remove the barriers that prevent the quick transfer and integration of knowledge, best available techniques and technological breakthroughs to the market, as well as to foster the development of an internal market of water technology; highlights the importance of eco-innovation for the conservation of water resources, biodiversity and balanced ecosystems; points out the potential for the creation of ‘green jobs’, an innovation- and knowledge-based water policy, better water management and water efficiency; calls on the Commission to evaluate and quantify the impact on employment of its actions to promote the growth of RD in the area of water;

Calls for the Commission to represent the European Union at the Fourth World Water Forum with a mandate to seek recognition in the final ministerial declaration that access to drinking water is a fundamental human right; calls, in this context, for the European Union and its Member States to propose, under the auspices of the United Nations, the drafting of an international treaty on water and the management of water resources which recognises the right to access to drinking water;

There are three parts to the strategy: first, changes to the International Boundary Waters Treaty Act in order to give the federal government regulatory power over the bulk removal of boundary waters; second, a joint reference, with the United States and the IJC, to investigate the effects of consumption, diversion and removal of water, including for export purposes, in boundary waters; and third, a proposal to develop, in co-operation with the provinces and territories, a Canada-wide accord on bulk water removal so as to protect Canadian water basins (1820) On February 10, 1999, Canada and the United States appointed the IJC. After noting a growing number of proposals to export water from the Great Lakes and other areas of the United States and Canada, the two countries agreed to ask the commission to study the issue and make recommendations within the next year.

In addition to proposing amendments to the International Boundary Waters Treaty Act and thereby prohibiting bulk water removal from Canadian boundary waters, including the Great Lakes, the federal strategy also announced that there would be a joint reference, with the United States, to the International Joint Commission (IJC) to study the effects of water consumption, diversion and removal (including for export) from boundary waters, with an initial emphasis on the Great Lakes.
