The provisions of this Regulation shall, in the field of transport by rail, road and inland waterway, apply both to all agreements, decisions and concerted practices which have as their object or effect the fixing of transport rates and conditions, the limitation or control of the supply of transport, the sharing of transport markets, the application of technical improvements or technical cooperation, or the joint financing or acquisition of transport equipment or supplies where such operations are directly related to the provision of transport services and are necessary for the joint operation of services by a grouping within the meaning of Article 3 of road or inland waterway transport undertakings, and to the abuse of a dominant position on the transport market.
Dans le domaine des transports par chemin de fer, par route et par voie navigable, les dispositions du présent règlement s'appliquent aux accords, décisions et pratiques concertées qui ont pour objet ou pour effet la fixation des prix et conditions de transport, la limitation ou le contrôle de l'offre de transport, la répartition des marchés de transport, l'application d'améliorations techniques ou la coopération technique, le financement ou l'acquisition en commun de matériel ou de fournitures de transport directement liés à la prestation de transport, pour autant que cela soit nécessaire pour l'exploitation en commun d'un groupement d'entreprises de transport par route ou par voie navigable tel que défini à l'article 3, ainsi qu'aux positions dominantes sur le marché des transports.

The system of rules on competition for transport should apply equally to the joint financing or acquisition of transport equipment for the joint operation of services by certain groupings of undertakings, and also to certain operations in connection with transport by rail, road or inland waterway of providers of services ancillary to transport.
Le régime de concurrence pour les transports rend souhaitable d'y inclure, dans la même mesure, le financement ou l'acquisition en commun de matériel de transport pour l'exploitation en commun par certains groupements d'entreprises, ainsi que certaines opérations des auxiliaires de transport pour les transports par chemin de fer, par route et par voie navigable.

In order that an improvement may be fostered in the sometimes too dispersed structure of the industry in the road and inland waterway sectors, exemption from the prohibition on restrictive agreements should also be granted in the case of those agreements, decisions and concerted practices providing for the creation and operation of groupings of undertakings in these two transport sectors whose object is the carrying on of transport operations, including the joint financing or acquisition of transport equipment for the joint operation of services.
En vue de favoriser une amélioration de la structure parfois trop dispersée de la profession dans les secteurs des transports par route et par voie navigable, il convient également d'exempter de l'interdiction des ententes les accords, décisions et pratiques concertées visant à la création et au fonctionnement de groupements d'entreprises de ces deux modes de transport qui ont pour objet l'exécution d'activités de transport, y inclus le financement ou l'acquisition en commun de matériel de transport pour l'exploitation en commun.
