In accordance with Article 6a of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, as annexed to the TEU and to the TFEU, the United Kingdom and Ireland are not bound by the rules laid down in this Directive which relate to the processing of personal data by the Member States when carrying out activities which fall within the scope of Chapter 4 or Chapter 5 of Title V of Part Three of the TFEU where the United Kingdom and Ireland are not bound by the rules governing the forms of judicial cooperation in criminal matters or police cooperation which require compliance with the provisions laid down on the basis of Article 16 TFEU.

By letter to the President of the Council of 24 July 2013, the United Kingdom made use of the above possibility through notifying that it did not accept the said powers of the Commission and of the Court of Justice, with the consequence that the relevant acts in the field of police cooperation and judicial cooperation in criminal matters have ceased to apply to the United Kingdom on 1 December 2014.

Furthermore, insofar as its provisions relate to the provisions of Eurodac, by letter of 23 September 2009 to the President of the Council, the United Kingdom has notified its wish to take part in the adoption and application of this Regulation, in accordance with Article 3 of the Protocol on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice annexed to the TEU and the TFEU. The United Kingdom therefore takes part in the adoption of this Regulation, is bound by it and subject to its application.

222. Takes the view that all internal services within the Council (inter alia, the Policy Unit and the Joint Situation Centre) and the Commission (the Crisis Management and Conflict Prevention Unit in the Directorate-General for External Relations and relevant services in the Directorate-General for Justice, Freedom and Security), should be strengthened in the framework of the implementation of the EU Security Strategy and the counter-terrorism strategy in close cooperation with all Member States, and that their cooperation with each other, as well as with Member States, be clearly regulated and data protection be ensured; considers that Parliament should be involved fully in this regard by granting it oversight powers similar to those of national parliamentary oversight committees, and that the Court of Justice be granted competence in this area; underlines that the competence of the EU in the field of combating terrorism should be significantly strengthened;
222. est d'avis que tous les services internes du Conseil (notamment l'unité politique et le centre de situation conjoint) et de la Commission (l'unité de gestion des crises et de prévention des conflits au sein de la direction générale "Relations extérieures" et les services compétents de la direction générale "Justice, liberté et sécurité") devraient être renforcés dans le cadre de la mise en œuvre de la stratégie de sécurité de l'UE et de la stratégie antiterroriste en étroite coopération avec tous les États membres; considère que leur coopération mutuelle et avec les États membres devrait être clairement réglementée et la protection des données assurée; estime que le Parlement devrait être pleinement associé à cette coopération et qu'il convient donc de lui conférer des pouvoirs de contrôle analogues à ceux dévolus aux commissions de contrôle des parlements nationaux et que la Cour de justice devrait également disposer de compétences dans ce domaine; souligne que la compétence de l'UE dans le domaine de la lutte contre le terrorisme devrait être renforcée de façon significative;
