In the event that the products are transported to a Member State other than the Member State of landing, the transporter shall also transmit, within 48 hours following the loading of the fisheries products, a copy of the transport document to the competent authorities of the Member State in whose territory the first marketing is declared to take place.

The Member States of transhipment shall communicate to the Member States of destination the information taken from the transport documentation on the nature of the fishery products, their weight, the port of loading and the shipper in the third country, the names of the transport vessels and the ports of transhipment and destination, as soon as possible this information is known and prior to the anticipated date of arrival in the port of destination.

(10) Member States must allow, in accordance with Decision 93/465/EEC , intermodal loading units bearing the CE marking and the symbols provided for in this Directive showing that the period inspection has been carried out, to move freely on their territory, to be placed on the market, to be used for any transport operation or to be used in accordance with their intended purpose, without requiring further assessment for reasons arising from the implementation of this Directive, or, as far as the European intermodal loading unit is concerned, without requiring conformity with further technical requirements.
(10) Les États membres doivent autoriser, selon la décision 93/465/CEE , la libre circulation sur leur territoire, la mise sur le marché, l'utilisation pour toute opération de transport ou l'utilisation conformément à leur destination, des unités de chargement intermodales portant le marquage CE et les symboles, prévus dans la présente directive, indiquant que le contrôle périodique a été effectué, sans exiger d'évaluation supplémentaire pour des motifs tenant à l'application de la présente directive ou, en ce qui concerne l'unité européenne de chargement intermodale, la conformité à d'autres exigences techniques.

2. Member States shall presume that intermodal loading units and European intermodal loading units bearing the CE marking provided for in Article 8 and with the EC declaration of conformity provided for in Annex VII are in conformity with all the relevant provisions of this Directive.

Les États membres présument conformes à toutes les dispositions de la présente directive les concernant, les unités de chargement intermodales et les unités européennes de chargement intermodales portant le marquage CE prévu à l'article 8 et munis de la déclaration de conformité prévue à l'annexe VII.

(11) It is appropriate that a Member State should be able to take measures, whilst keeping the Commission informed, to limit or prohibit the placing on the market and use of intermodal loading units, in particular, in cases where they present a particular risk to the safety of persons and, where appropriate, domestic animals or property, or when units which have the CE marking, the symbol referring to the reassessment of these units or the symbol relating to the periodic inspection do not conform .
(11) Il convient qu'un État membre puisse prendre des mesures, en informant la Commission, pour limiter ou interdire la mise sur le marché et l'utilisation d'unités de chargement intermodales notamment lorsque celles-ci présentent un risque particulier pour la sécurité des personnes et, le cas échéant, des animaux domestiques ou des biens, ou lorsque ces unités munies du marquage CE, du symbole se référant à la réévaluation de ces unités ou du symbole relatif au contrôle périodique sont non conformes.

2. The operator, agent or master of a ship, irrespective of its size, carrying dangerous or polluting goods coming from a port located outside the Community and bound for a port of a Member State or an anchorage located in a Member State's territorial waters shall, at the latest upon departure from the loading port or as soon as the port of destination or the location of the anchorage is known, if this information is unavailable at the moment of departure, notify the information indicated in Annex I(3) to the competent authority of the Member State in which the first port of destination or anchorage is located.
