16 (1) The Minister may, after consultation with the provinces that would be affected by a proposed exemption, exempt from the application of any provision of this Act or the regulations, either generally or for a limited period or in respect of a limited area, any person, the whole or any part of any extra-provincial motor carrier undertaking or any class of those undertakings, if in the opinion of the Minister the exemption is in the public interest and is not likely to affect motor carrier safety.

Proposed paragraph 16.1(1)(h) of Bill S-3 permits the federal government to make regulations to attain the objectives of the act and to prescribe the conditions of carriage and the limitations of liability that apply with respect to extraprovincial motor carrier undertakings.

3. For any claim up to the amount of EUR 220 000 per passenger, a carrier shall not exclude or limit its liability by proving that it has taken the care required pursuant to paragraph 4(a), unless the total amount of the resulting claim exceeds the amount for which compulsory insurance is, in conformity with Second Council Directive 84/5/EEC of 30 December 1983 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles, required under the national legislation of the Member state in which the bus or coach is normally based. In such a situation, liability shall be limited to that amount.
3. For any claim up to the amount of EUR 220 000 per passenger, a carrier shall not exclude or limit its liability by proving that it has taken the care required pursuant to paragraph 4(a), unless the total amount of the resulting claim exceeds the amount for which compulsory insurance is, in conformity with Directive 2009/103/EC of the European Parliament and of the Council of 16 September 2009 relating to insurance against civil liability in respect of the use of motor vehicles and the enforcement of the obligation to insure against such liability , required under the national legislation of the Member state in which the bus or coach is normally based.

Proposed section 16(1) would provide that the Minister could, after consultation with any affected provinces, exempt from the application of any provision of the Act or the regulations, either generally or for a limited period, or in respect of a limited area, any person, or the whole or any part of any extra-provincial motor carrier undertaking or any class of those undertakings, provided the Minister believed the exemption would be in the public interest and would not be likely to affect motor carrier safety.
