3. Any court in Canada that, having regard to the parties, the nature of the action and the amount involved, has jurisdiction and that exercises jurisdiction in the place where the nuclear installation at or in relation to which a nuclear incident referred to in section 2 occurs, has the same jurisdiction to entertain any application or grant any relief or remedy arising out of or relating to injury or damage occasioned in the United States resulting from that nuclear incident as the court would have, under the Nuclear Liability Act, in respect of that injury or damage if it had been occasioned in Canada.
3. (2) No party shall have any right to claim or receive any compensation, damages, indemnity or other form of relief from Her Majesty in right of Canada or from any servant or agent thereof for any acquired, vested or future right or entitlement or any prospect thereof that is replaced or otherwise affected by this Act, or for any duty or liability imposed on that party by this Act.
