The provisions of this Regulation shall, in the field of transport by rail, road and inland waterway, apply both to all agreements, decisions and concerted practices which have as their object or effect the fixing of transport rates and conditions, the limitation or control of the supply of transport, the sharing of transport markets, the application of technical improvements or technical cooperation, or the joint financing or acquisition of transport equipment or supplies where such operations are directly related to the provision of transport services and are necessary for the joint operation of services by a grouping within the meaning of Article 3 of road or inland waterway transport undertakings, and to the abuse of a dominant position on the transport market.

The purpose is to ensure smooth passage in international road transport, and thereby to facilitate the operation of the internal market.

5. Member States shall ensure that fuels marketed in their territory and intended for use by non-road mobile machinery and agricultural tractors meet the specifications indicated under Annex IV by 1 January 2005. By 1 January 2008 at the latest the maximum permissible sulphur content of fuels intended for use by non-road mobile machinery and agricultural tractors shall be 10 mg/kg (ppm) in accordance with Annex IV. However, Member States may require the same sulphur content as for diesel fuels as stipulated in this Directive prior to 2005.
5. Les États membres veillent à ce que les carburants commercialisés sur leur territoire et destinés à être utilisés pour les engins mobiles non routiers et les tracteurs agricoles soient, à compter du 1er janvier 2005, conformes aux spécifications de l'annexe IV. Au plus tard le 1er janvier 2008, la teneur maximale en soufre admissible pour les carburants destinés aux engins mobiles non routiers et aux tracteurs agricoles est de 10 mg/kg (ppm), conformément à l'annexe IV. Toutefois, les États membres peuvent imposer avant 2005 la même teneur en soufre que celle définie pour les carburants diesel et indiquée dans la présente directive.
