Since Article 30 of the EC Treaty provides for an exception, to be interpreted strictly (20), to the rule of free movement of goods within the Community, it is for the national authorities which invoke it to show in each case that the application of their rules is necessary to give effective protection to the interests referred to in Article 30 of the EC Treaty and, in particular, that the approval of the motor vehicle in question poses a real risk to human health or road safety.
L'article 30 du traité CE comportant une exception, d'interprétation stricte (20), à la règle de la libre circulation des marchandises à l'intérieur de la Communauté, il incombe aux autorités nationales qui l'invoquent de démontrer, dans chaque cas d'espèce, que leur réglementation est nécessaire pour protéger effectivement les intérêts visés audit article et, notamment, que la réception du véhicule à moteur en question présente un risque réel pour la santé humaine ou la sécurité routière.
