To assist in its deliberations, the committee received written submissions from the Canadian Bar Association's national criminal justice section and heard from witnesses representing the Criminal Lawyers' Association and the British Columbia Civil Liberties Association.

O. whereas the application of Union instruments in the field of criminal justice, including, in this connection, respect for fundamental rights, as well as the development of an area of criminal justice, are dependent on the effective functioning of national criminal justice systems;

C. whereas any evaluation of criminal justice should take account of the prerogatives of the Member States and national law in this area, and remain within the bounds of the Union’s responsibility for coordination only; whereas any value judgment regarding national criminal justice systems should be avoided;

I'm going to ask Ms. Perkins-McVey, who is chair of the criminal justice section, to address some of the issues that are outlined in the written submission (1200) Ms. Heather Perkins-McVey (Chair, National Criminal Justice Section, Canadian Bar Association): It's often said that this is the area in the Criminal Code where law and psychiatry meet.

In such cases, which affect us all, we have to call upon either national criminal justice systems, through mechanisms which closely cooperate with one other, or properly constituted international criminal tribunals such as those created for the former Yugoslavia and Rwanda, set up by the Security Council, or in the near future by the International Criminal Court itself.

F. whereas some obstacles to effective police and court cooperation are the result of the bureaucratic procedures between the Member States and of the differences between the national criminal justice systems (differing definitions of offences and differing requirements regarding the collection of evidence and its use in criminal proceedings) and it is therefore essential to work towards harmonized criminal procedure,
