In order to determine whether entities such as United Utilities Water plc, Yorkshire Water Services Ltd and Southern Water Services Ltd can be classified as legal persons which perform ‘public administrative functions’ under national law, within the meaning of Article 2(2)(b) of Directive 2003/4/EC of the European Parliament and of the Council of 28 January 2003 on public access to environmental information and repealing Council Directive 90/313/EEC, it should be examined whether those entities are vested, under the national law which is applicable to them, with special powers beyond those which result from the normal rules applicable in relations between persons governed by private law.

(25) In order to assist in the rapid identification of contaminated sites, the owner of a site where, according to official records such as national registers or cadastres, a soil-polluting activity has taken or is taking place, or the prospective buyer should, prior to completing the land transaction, provide relevant information on the status of the soil to the competent authority and to the other party in the transaction.

2. A national provision which, in order to give consumers greater protection against misleading advertising and for the sake of protecting health, firstly, prohibits advertising of cosmetic products by means of misleading statements concerning health and, secondly, introduces a national control system on the basis of which buyers must not be given the impression that a cosmetic product has certain effects if its composition does not include the substances which, in the opinion of the national legislature, alone justify and confirm the claim that it has such effects, and otherwise it is necessary to obtain special prior authorisation to advertise and to market the product, goes further than the restrictions authorised by Article 6(3) of Directive 76/68 and is therefore incompatible with Community law.

IV. In Annex VI , the following paragraph is introduced after the first paragraph entitled "General principles" : "Pending the adoption of rules in Sections A and B of this Annex, and in order to cover specifically the preparation of foodstuffs composed of one or more livestock products, national rules shall apply".
