The EU Air Safety List is established by the European Commission, pursuant to Regulation (EC) No 2111/2005 of the European Parliament and the Council of 14 December 2005 on the establishment of a Community list of air carriers subject to an operating ban within the Community and on informing air transport passengers of the identity of the operating air carrier and on the basis of the advice of the EU Air Safety Committee.
La liste d'interdiction de l'UE est établie par la Commission européenne, en vertu du règlement (CE) n° 2111/2005 du Parlement européen et du Conseil, du 14 décembre 2005, concernant l’établissement d’une liste communautaire des transporteurs aériens qui font l’objet d’une interdiction d’exploitation dans la Communauté et l’information des passagers du transport aérien sur l’identité du transporteur aérien, et sur la base de l'avis du comité de la sécurité aérienne de l'UE.

1. When an operating air carrier reasonably expects a flight to be delayed, or an operating air carrier postpones the scheduled time of departure beyond its originally scheduled time of departure, passengers shall be offered by the operating air carrier:

The air carrier and the tour operator must inform the air carriage contractor about the name of the operating air carrier, especially in case of a change of operating air carrier.

2. Where the identity of the operating air carrier or carriers is not yet known at the time of reservation, the air carriage contractor shall ensure that the passenger is informed of the name or names of the air carrier or carriers that is or are likely to act as operating air carrier or carriers on the flight or flights concerned.

The contracting air carrier has to ensure that the passenger is informed of the identity of the operating air carrier when making a reservation.

If the identity is not known at the time of reservation, the contracting air carrier must inform passengers of the identity of the operating air carrier as soon as such identity is established.

This list will reproduce, verbatim, the various national lists, mentioning the Member States in which the respective bans are in force. the obligation imposed on the contracting air carrier to ensure that the passenger is informed of the identity of the operating air carrier(s) when making a reservation.
