8. Where streets or highways are affected by the said works but are not crossed by the Company’s tracks or diverted incidental to any such crossing and by reason thereof the Board of Railway Commissioners for Canada has no jurisdiction under the Railway Act with respect thereto, the Company may with the approval of the Governor in Council enter into agreements, where it may be desirable, with the City of Montreal or with any other municipality with respect to such streets or highways or with respect to the opening of new streets, the closing of existing streets and ways, the making of diversions or widenings of such streets or highways, and the making of substreets, subways or overhead facilities in connection with such streets or highways, and the apportionment of the cost thereof.
8. Lorsque des rues ou des voies publiques sont affectées par lesdits ouvrages mais ne sont pas croisées par les rails de la Compagnie ni détournées par suite de ce croisement et que, pour cette raison, la Commission des chemins de fer du Canada n’a aucune juridiction à cette égard en vertu de la Loi des chemins de fer, la Compagnie peut, avec l’approbation du gouverneur en son conseil, conclure des arrangements, si c’est désirable, avec la cité de Montréal ou avec toute autre municipalité à l’égard de ces rues ou voies publiques ou à l’égard de l’ouverture de nouvelles rues, de la fermeture de rues et de chemins actuels, de l’exécution de détournements ou d’élargissements de ces rues ou voies publiques et de la construction de rues inférieures, passages souterrains ou installations supérieures relatives à ces rues ou voies publiques et à la répartition de leur coût.
