The aim of mutual recognition and supervision of suspended sentences, conditional sentences, alternative sanctions and decisions on conditional release is to enhance the prospects of the sentenced person’s being reintegrated into society, by enabling that person to preserve family, linguistic, cultural and other ties, but also to improve monitoring of compliance with probation measures and alternative sanctions, with a view to preventing recidivism, thus paying due regard to the protection of victims and the general public.
La reconnaissance mutuelle et la surveillance des peines assorties du sursis avec mise à l’épreuve, des condamnations sous condition, des peines de substitution et des décisions de libération conditionnelle visent à accroître les chances de réinsertion sociale de la personne condamnée en lui donnant la possibilité de conserver ses liens familiaux, linguistiques, culturels et autres; l’objectif consiste toutefois également à améliorer le contrôle du respect des mesures de probation et des peines de substitution dans le but de prévenir la récidive et de tenir ainsi compte du souci de protection des victimes et de la société en général.

10. Considers that the matters discussed in the successive rounds of dialogue with China, such as ratification of the ICCPR, reform of the criminal justice system, including the death penalty and the system of re-education through work, freedom of expression, particularly on the Internet, freedom of the press, freedom of access to information, freedom of conscience, thought and religion, the situation of minorities in Tibet, the release of detainees following the events in Tiananmen Square, and workers' and other rights, must continue to be raised in the context of the dialogue, in particular with regard to the application of the recommendations resulting from previous dialogues mutually agreed upon by both parties and the seminars on legal affairs; to this end, calls on the Council to consider extending the time period of the dialogue and to allow more time for discussion of the issues raised; calls, furthermore, on the Council and Commission to pay special attention to compliance with International Labour Organisation conventions with regard, in particular, to independent trade unions and child labour;
10. estime que les thèmes traités au cours des cycles de dialogues successifs avec la Chine, comme la ratification du PIDCP, la réforme du système judiciaire pénal, y compris la peine de mort et les systèmes de rééducation par le travail, la liberté d'expression, en particulier via internet, la liberté de la presse, le libre accès aux informations, la liberté de conscience, de pensée et de religion, la situation des minorités au Tibet, la libération des détenus après les événements de la place Tienanmen, les droits des travailleurs et les autres droits, doivent continuer à s'inscrire dans le cadre du dialogue, en particulier en ce qui concerne l'application des recommandations issues des dialogues antérieurs et adoptées d'un commun accord par les deux parties et des séminaires sur des questions juridiques; demande dans ce sens au Conseil d'envisager de prolonger le dialogue et d'étendre le temps consacré à la discussion de chacun des thèmes soulevés; demande en outre au Conseil et à la Commission d'accorder une attention particulière au respect des conventions de l'Organisation internationale du travail (OIT) concernant notamment les syndicats indépendants et le travail des enfants;

Calls on the EU Troika to continue to discuss intensively, in the context of the dialogue, matters of concern such as the ratification of the UN International Covenant on Civil and Political Rights, reform of the criminal justice system, including the death penalty and the system of re-education through labour, freedom of expression, particularly on the internet, freedom of the press, freedom of conscience, thought and religion, the situation of minorities in Tibet and Xinjiang, the release of detainees following the events in Tiananmen Square, and workers’ and other social and economic rights; calls, furthermore, on the Council and the Commission to pay special attention to compliance with the ILO's conventions with regard, in particular, to independent trade unions and child labour ;
20. invite la Troïka de l'UE à poursuivre résolument ses travaux dans le contexte des points de dialogue préoccupants tels que la ratification de l'ICCPR, la réforme du système de justice pénale, en ce compris la peine de mort et le système de rééducation par le travail, la liberté d'expression, en particulier pour ce qui est d'Internet, la liberté de la presse, la liberté de conscience, la liberté de pensée et la liberté religieuse, la situation des minorités au Tibet, à Xinjiang, la libération des personnes incarcérées à la suite des événements de la place Tiananmen, les droits des travailleurs et autres droits économiques et sociaux; demande en outre au Conseil et à la Commission d'accorder une attention particulière au respect des conventions de l'OIT concernant notamment les syndicats indépendants et le travail des enfants;
