The Commission considers that Spanish law , even after an amendment in 2003, does not correctly implement the concept of bodies governed by public law within the meaning of the Directive, since it excludes certain bodies governed by private law, such as foundations, from the definition and hence from the scope of the Directive.
La Commission considère que la loi espagnole , même après une modification en 2003, ne transpose pas correctement la notion d'organismes de droit public de la directive, puisqu’elle exclut de cette notion et donc du champ d'application de la Directive, certaines entités de droit privé, telles que les fondations.
