(45) In order to ensure uniform conditions for the implementation of this Regulation as regards imports, implementing powers should also be conferred on the Commission in respect of measures laying down fixed quantities of agricultural products considered to have been used in the manufacturing of the processed agricultural products for the purposes of the reduction or phasing out of import duties applicable in preferential trade and establishing the appropriate documentary requirements, the annual tariff quotas and the method of administration to be used for the import of processed agricultural products and certain agricultural products in accordance with the Union's international commitments, procedures for the application of specific provisions laid down in international agreements or acts adopting the import or export regime in particular on the guarantees covering the nature, provenance and origin of the product, recognition of the document used for verifying these guarantees , the presentation of a document issued by the exporting country and on the destination and use of the products , measures laying down the period of validity of import licences, the procedure for lodging a security and its amount, the use of those import licences and, where necessary, the specific measures relating to, in particular, the conditions under which applications for import are to be submitted and authorisation granted within the tariff quota and the appropriate documentary requirements.
(45) Afin d'assurer des conditions uniformes d'exécution du présent règlement en ce qui concerne les importations, il convient de conférer des compétences d'exécution à la Commission en vue d'adopter des mesures établissant les quantités fixes de produits agricoles considérées avoir été utilisées dans la fabrication des produits agricoles transformés aux fins de la réduction ou de l'élimination progressive des droits à l'importation applicables aux échanges préférentiels ainsi que les exigences documentaires appropriées, les contingents tarifaires annuels et la méthode d'administration à appliquer pour l'importation de produits agricoles transformés et de certains produits agricoles conformément aux engagements internationaux de l'Union, les procédures pour l'application de dispositions spécifiques établies dans des accords internationaux ou dans des actes portant adoption du régime d'importation ou d'exportation, en particulier les garanties quant à la nature, à la provenance et à l'origine du produit, la reconnaissance du document permettant de vérifier ces garanties, la présentation d'un document délivré par le pays exportateur ainsi que la destination et l'utilisation du produit, des mesures concernant la période de validité des licences d'importation, les procédures de constitution de garantie et le montant de celle-ci , l'utilisation de ces licences d'importation et, le cas échéant, les mesures spécifiques relatives notamment aux conditions selon lesquelles les demandes d'importation doivent être soumises et l'autorisation accordée dans le cadre du contingent tarifaire et les exigences documentaires appropriées.

The following recital is inserted: " (24a) In order to adopt the provisions necessary for the application of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of granting the requesting country the special incentive arrangement for sustainable development and good governance and to amend Annex I to this Regulation accordingly, adopting detailed rules for implementing the provisions regarding the reduction of Common Customs Tariff duties on the products under tariff heading 1701, suspending Common Customs Tariff duties on the products under tariff headings 1006 and 1701, requiring import licences for imports of products under tariff heading 1701, removing a country from the arrangement by amending Annex I and to establish a transitional period, suspending the preferential arrangements provided for in this Regulation, temporarily withdrawing the preferential arrangements in respect of all or of certain products originating in a beneficiary country, and amending Annex I to this Regulation.

Le considérant suivant est inséré: " (24 bis) Afin d'adopter les dispositions nécessaires à l'application du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité, en vue d'accorder au pays demandeur le régime spécial d'encouragement en faveur du développement durable et de la bonne gouvernance et de modifier l'annexe I du présent règlement en conséquence, d'adopter les modalités nécessaires à la mise en œuvre des dispositions relatives à la réduction des droits du tarif douanier commun applicables aux produits relevant de la position tarifaire 1701, à la suspension des droits du tarif douanier commun applicables aux produits relevant des positions tarifaires 1006 et 1701, à l'exigence d'un certificat d'importation pour les importations de produits relevant de la position tarifaire 1701, de retirer un pays du régime en modifiant l'annexe I et de mettre en place une période transitoire, de suspendre les régimes préférentiels prévus par le présent règlement, de retirer temporairement le bénéfice des régimes préférentiels en ce qui concerne tout ou partie des produits originaires d'un pays bénéficiaire, et de modifier l'annexe I du présent règlement.

In addition, it is appropriate, for the sake of clarity and transparency, that those rules include the obligation to specify the preferential import duty in box 24 of licence applications and licences.

Where imports of a product are subject to presentation of an import licence and where that licence also serves to determine eligibility under preferential arrangements, the quantities imported within the tolerance in excess of the quantity shown on the import licence shall not qualify under the preferential arrangements.

Where an import licence covering an agricultural product is also used to administer a tariff quota to which preferential arrangements apply, such preferential arrangements are to apply to importers by virtue of the licence or certificate which must, in some cases, be accompanied by a document from a third country.

Identification of the country of origin in the case of tariff quotas or in the case of non-preferential imports should be made a primary requirement within the meaning of Commission Regulation (EEC) No 2220/85 of 22 July 1985 laying down common detailed rules for the application of the system of securities for agricultural products (5), and entry of the country of origin for the quotas in question and for non-preferential imports in column 31 of the import licence or extract thereof should therefore be required.

4. Where imports of a product are not subject to presentation of an import licence and where an import licence serves to administer preferential arrangements covering that product, import licences shall not provide for any tolerance for quantities in excess.

To guarantee to full-time refiners in the Member States concerned that import licences for the sugar for refining will be available for the quantity indicated in those paragraphs and to avoid any abuse allowing trading in licences, applications for import licences for sugar for refining should be limited to full-time refiners in the Member State concerned until a date set by type of preferential sugar.
Afin de garantir aux raffineurs à temps plein des États membres concernés la disponibilité de certificats d'importation pour le sucre à raffiner pour la quantité indiquée auxdits paragraphes et d'éviter des abus permettant le marchandage de certificats, il est souhaitable de prévoir que la demande de certificats d'importation pour le sucre à raffiner soit restreinte aux raffineurs à temps plein de l'État membre concerné jusqu'à une date fixée selon le sucre préférentiel.
