According to the Romanian authorities, the preliminary checks carried out (relating, in particular, to a statement by another Member of the European Parliament, a copy of the invoice and the audio recordings supplied by the media) have resulted in the serious suspicion that, after making a deal with the representatives of the self-styled lobbying company, Mr Severin contacted – both personally and through his secretariat – at least one other Member of the European Parliament with the aim of discovering whether an amendment had been tabled for discussion in the Committee on Legal Affairs concerning the time limit for the reimbursement of depositors in the case of a bank failure.
Selon les autorités roumaines, il ressort des vérifications préliminaires effectuées (concernant notamment les déclarations d'un autre député au Parlement européen, la copie de la facture et les enregistrements audio fournis par les médias), qu'un grave soupçon pèse sur M. Severin, lequel, après avoir conclu un accord avec les représentants de la prétendue société de conseil, aurait contacté, en personne ou par l'intermédiaire de son secrétariat, au moins un autre député au Parlement européen afin de savoir si un amendement concernant les délais de remboursement des déposants en cas de faillite bancaire, avait été présenté pour examen au sein de la commission juridique.

In such a case, the design of the system would be based on the European Ministry for Public Affairs within which Eurojust and specialist investigative bodies (OLAF and Europol) would merge, with everything under the judicial supervision of a European Preliminary Chamber which would safeguard individual freedoms and the rights of the defence and the functioning of which would be facilitated by the greatest possible standardisation of criminal-law rules and procedures: common rules on evidence, a European model for police or witness statements, a common definition of offences, etc.
Dans cette hypothèse l'architecture du système reposerait sur le ministère public européen, au sein duquel se fondrait Eurojust, des services d'enquêtes spécialisés (OLAF et Europol), le tout sous le contrôle juridictionnel d'une Chambre préliminaire européenne, garante des libertés individuelles et des droits de la défense, et dont le fonctionnement serait facilité par l'unification des règles et des procédures pénales, la plus complète possible: des règles communes de preuves, un procès-verbal européen, la définition des incriminations etc..
