97.1 (1) Every exporter of goods to a free trade partner for which preferential tariff treatment under a free trade agreement will be claimed in accordance with the laws of that free trade partner shall certify in writing in the prescribed form and containing the prescribed information that goods exported or to be exported from Canada to that free trade partner meet the rules of origin set out in, or contemplated by, the applicable free trade agreement and, if the exporter is not the producer of the goods, the certificate shall be completed and signed by the exporter on the basis of the prescribed criteria.

In this regard the Union should offer to OCTs the best possible treatment offered to any other trading partner through comprehensive most favoured nation clauses, while ensuring more flexible possibilities for trade relations for OCTs by limiting the treatment offered by OCTs to the Union to what has been offered to other major trading economies.

Recognises that the conclusion of the WTO agreements on trade in bananas put an end to a long-term dispute with Latin American and ACP partner countries’ banana suppliers, could facilitate progress in the Doha Round negotiations and has contributed to concluding the negotiations on the various agreements with Central America and Colombia and Peru; calls, nonetheless, for account to be taken of the commitments made to ACP partners and the interests of EU producers; calls, in order to avoid further disputes, for fair treatment to be guaranteed to all trade partners in Latin America, including those who have not concluded a trade agreement with the EU;

At the same time any preferential treatment granted for trade with a neighbouring country of an outermost region, in the absence of an economic integration agreement in the WTO sense or of a waiver, should be regarded as incompatible with the WTO's fundamental principle of non-discrimination, unless the same preferential treatment is also granted for trade with any other trading partner which is a member of the WTO.
