In such a case, the Member State shall give a statement of its reasons for withholding approval.

Recalls paragraph 4 of its discharge decision of 10 April 2002 for the financial year 2000 concerning the President's overruling of withholding of approval (WOA) n° 01/06 (failure to keep an adequate record of interpreting costs during 2000); notes that at its meeting of 13-14 May 2002 the Bureau approved the conclusions of the administrative inquiry and instructed the Interpretation Directorate to assess the feasibility of the inquiry's recommendations; questions the usefulness of such a circular approach;

Points out that the Bureau's decision to overrule the withholding of approval was taken on the basis of the advice of Parliament's Legal Service containing an assessment of the relevant provisions of national and Community law; asks, nevertheless, the Secretary-General to ensure that on the occasion of the next renewal of the Strasbourg security contract the outgoing contractor provides the necessary information to potential successors at the appropriate stage in the tender procedure;
60. fait observer que la décision du Bureau tendant à passer outre au refus de visa a été prise sur la base de l'avis du service juridique du Parlement comportant une analyse des dispositions du droit national et du droit communautaire; demande néanmoins au Secrétaire général que, à l'occasion du prochain renouvellement du contrat de sécurité pour Strasbourg, l'adjudicataire sortant fournisse les informations nécessaires à ses successeurs potentiels au moment opportun de la procédure d'appel d'offres;

Points out that, in its note on the decisions to overrule the withholdings of approval by the financial controllers of the institutions for 1999, in accordance with Article 39(3) of the Financial Regulation, the Court of Auditors comments on cases 99/7 and 99/9 concerning Parliament, without however taking any account of the arguments on the basis of which the Bureau decided to overrule the withholdings of approval in question; points out that OLAF has been requested to conduct an investigation into this matter and it is now awaiting these findings;
