This harmonisation will in particular guarantee that the holder of a biotechnological patent can use a plant variety that contains his or her invention, when the holder of the plant variety right refuses to grant a contractual licence and when the invention represents significant technical progress of considerable economic interest.

2. In the case of varieties for which a national plant variety right was granted prior to the grant of the Community plant variety right, but to which Article 116 (4) 4th indent of the said Regulation does not apply, the extension referred to in paragraph 1 shall be reduced by the longest period in full years during which any national property right or rights granted have been effective in a Member State in respect of the same variety prior to the grant of the Community plant variety right.

Dans le cas des variétés pour lesquelles une protection nationale des obtentions végétales a été accordée avant l'octroi de la protection communautaire, mais auxquelles l'article 116 paragraphe 4 quatrième tiret dudit règlement ne s'applique pas, la prorogation visée au paragraphe 1 est diminuée de la plus longue période, exprimée en années, pendant laquelle le ou les titres de protection nationale ont porté effet dans un État membre à l'égard de la même variété, avant l'octroi de la protection communautaire de l'obtention végétale.

Whereas such extension should apply to all valid Community plant variety rights which were granted prior to the entry into force of this Regulation or which will be granted in future unless such a right is duly surrendered by the holder or terminated by a decision of the Community Plant Variety Office;
considérant que cette prorogation devrait s'appliquer à toutes les protections communautaires d'obtentions végétales en cours de validité accordées avant l'entrée en vigueur du présent règlement ou qui seront accordées à l'avenir, à moins que le titulaire du droit ne l'ait cédé en bonne et due forme ou en ait été déchu par une décision de l'Office communautaire des variétés végétales;

Whereas the period of extension should be reduced if a national property right or rights in respect of the same variety has or have been effective in a Member State prior to the grant of a Community plant variety right and, accordingly, would have allowed a breeder already to take advantage of his variety; whereas a comparable principle was already laid down under the transitional provisions of Article 116 of Regulation (EC) No 2100/94,

2. On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.
2. La Commission peut accorder au titulaire d'un brevet national ou communautaire ou au titulaire d'un droit d'obtention végétale qui ne peut pas exploiter son brevet (second brevet) ou son droit d'obtention végétale national ou communautaire sans porter atteinte à un brevet communautaire (premier brevet), sur demande, une licence obligatoire sur le premier brevet, à condition que l'invention ou l'obtention végétale revendiquée dans le second brevet ou le droit d'obtention végétale suppose un progrès technique important, d'un intérêt économique considérable, par rapport à l'invention revendiquée dans le premier brevet.
