Here all the pressure comes to bear when analyzing a piece of legislation such as this; and that is what is called the proportionality analysis. The operative concept here is that while government may limit rights, so long as the limit is prescribed by law and so long as government has a substantial and compelling purpose when doing so, government must show that it has been sensitive to the injuries to rights, that this is a rights-impairing piece of legislation.
