In addition to the basic legal requirement that self-regulatory initiatives must comply with all provisions of the Treaty (in particular internal market and competition rules), as well as with the international engagements of the Community, including multilateral trade rules, the following non-exhaustive list of indicative criteria may be used to evaluate the admissibility of self-regulatory initiatives as an alternative to an implementing measure in the context of this Directive:

The protocols on services of general interest and on the internal market and competition, both proposed by the Commission, guarantee a fair and undistorted functioning of the single market, while respecting legitimate concerns expressed by some Member States.

The adoption by the Member States of conflicting or different consumer protection rules governing the distance marketing of consumer financial services could impede the functioning of the internal market and competition between firms in the market.
Des dispositions divergentes ou différentes de protection des consommateurs prises par les États membres en matière de commercialisation à distance des services financiers auprès des consommateurs pourraient avoir une incidence négative sur le fonctionnement du marché intérieur et sur la concurrence entre les entreprises dans celui-ci.

(12) The adoption by the Member States of conflicting or different consumer protection rules governing the distance marketing of consumer financial services could impede the functioning of the internal market and competition between firms in the market.
