10.2 The National Stewardship Action Plan shall include, but is not limited to, (a) a commitment to regularly examine tax treatment and subsidies and to eliminate disincentives for actions taken by persons to protect species at risk; (b) a strategy for public education; (c) the establishment of mechanisms for sharing information both within and among various levels of governments and between the federal government and other persons; (d) the creation of awards and recognition programs; (e) methods of collecting and sharing knowledge about species at risk, including local and traditional knowledge; (f) the provision of information respecting methods to formalize commitments to land stewardship including land conservation easements, agreements or government programs; (g) a commitment to provide technical and scientific support to persons engaged in stewardship activities; and (h) a strategy for implementing the consultation provisions under this Act, including the provisions of subsections 48(3) and 66(3)" .

Question No. 413 Mr. Hoang Mai: With regard to the Canada Revenue Agency’s (CRA) response to the provisions of the Internal Revenue Service (IRS) regarding the Foreign Account Tax Compliance Act (FATCA): (a) according to the government’s analysis, do the FATCA provisions comply with the provisions of the Convention Between Canada and the United States of America With Respect to Taxes on Income and on Capital and its amending Protocol (2007); (b) how many citizens from the United States of America will be affected by FATCA, (ii) are there specific Canadian exemptions to FATCA; (c) has Canada negotiated with United States Treasury officials or the IRS following the announcement of FATCA provisions, (i) at what time was the government made aware of these provisions, (ii) how long did it take Canada to respond to the initial creation of FATCA and its implementation, (iii) are there ongoing negotiations in this regard; (d) will Canada inform dual citizens about FATCA and, if so, (i) how, (ii) at what time, (iii) what department or agencies will be responsible; (e) has the government conducted any studies or mandated a task force to look into how much FATCA will cost Canadians and, if so, what are the cost implications resulting from the additional regulations and demands, (i) for the government, (ii) for the CRA, (iii) for Canadian banks, (iv) who will absorb these costs, (v) are there other types of non-financial costs such as efficiency or fairness reductions; (f) which Canadian civil liberties associations or other types of association has the government met with to discuss the privacy implications of FATCA and what actions will the government undertake to protect the fundamental civil liberties of all Canadians in this regard; (g) according to the government’s analysis, do the FATCA provisions comply with the provisions of the Privacy Act or the Personal Information Protection and Electronic Documents Act, and if so, which department undertook this assesment; ...

Gerry Byrne: With regard to the investigation and prosecution of all licensed Canadian sealers who were charged under the Fisheries Act or the Marine Mammal Regulations as a result of actions taken by the sealers during the 1996 harvest of a category of Hooded Seals known as “Bluebacks”: (a) how many licensed sealers were originally charged due to actions arising from the harvesting of this class of hooded seal; (b) what was the final year in which the prosecution of any sealer from this group concluded; (c) how many were convicted of any offence during the course of this prosecution and what were they convicted of; (d) what specific regulation or statutory provision were they originally charged with and what regulation or statutory provision were they convicted of; (e) what is the total cost of both the investigation and the prosecution of these charges, broken down by each department or agency involved in any aspect of the investigation or prosecution of these charges; and (f) what is the description of any changes made to the Marine Mammal regulations subsequent to the conclusion of these cases and originating from circumstances made clear during the course of this investigation and prosecution?

This exemption was pursuant to those provisions of NAFTA that allow imports from Canada to be exempted from actions if certain conditions are met (1650) Over the past several years, this particular provision of NAFTA has meant that Canadian imports were exempt from the application of American safeguard action on such products as steel wire rod, line pipe, wheat gluten, tomatoes and bell peppers, and corn brooms.

Those recommendations include: recommendation 1 that the Government of Canada take immediate steps to introduce legislation to include a non-derogation clause within the federal Interpretation Act; recommendation 2, that the legislation to amend the Interpretation Act also provide for the repeal of all non-derogation clauses relating to Aboriginal and treaty rights included in federal legislation since 1982; unequivocal direction that any non-derogation provision in the Interpretation Act is to be ``read in'' as a provision binding the Crown in all its federal statutes; a clear provision that any non-derogation provision in the Interpretation Act will be constructive in terms of processes and mechanisms that will be established, implemented, monitored and enforced, as distinct from merely presumptive in respect of the correctness of any action or decision of the federal government; and the development of the judicially reviewable and enforceable code of conduct and the policy and procedure applicable to all of the Government of Canada to give practical effect to the inclusion of a non-derogation provision in the federal Interpretation Act.
