Since the objective of this Regulation, namely to establish a specialised body to formulate common solutions on matters concerning railway safety and interoperability, cannot be sufficiently achieved by the Member States but can rather, by reason of the joint nature of the work to be done, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

(2) A person to whom a notice is given under subsection (1) may file with the proponent an objection to the proposed railway work if the person considers that the proposed railway work would prejudice their safety or the safety of their property. The objection must include reasons and be filed before the expiry of the period specified in the notice for the filing of objections, and a copy of it must be filed without delay with the Minister.
(2) Le destinataire de l’avis qui considère que les travaux qui y sont visés portent atteinte à sa sécurité ou à celle de ses biens — meubles ou immeubles — peut, dans le délai prévu dans l’avis, notifier au promoteur son opposition motivée à leur égard, auquel cas il dépose sans délai copie de cette notification auprès du ministre.

(2) Where a proposed railway work results, directly or indirectly, from an order of the Agency under section 7 or 8 of the Railway Relocation and Crossing Act and would improve the safety of a crossing at grade of a road and a line of railway, the proponent may file an application with the Minister for a grant in respect of that proposed railway work.
(2) Le promoteur peut aussi déposer une telle demande lorsque, d’une part, les installations ferroviaires projetées visent à accroître la sécurité d’un franchissement routier par passage à niveau, d’autre part, le projet découle d’une ordonnance de l’Office visée aux articles 7 ou 8 de la Loi sur le déplacement des lignes de chemin de fer et les croisements de chemin de fer.

3. These Regulations apply in respect of any owner, operator or lessee of a non-railway works that constructs, alters or operates, after the coming into force of these Regulations, any non-railway works within the space enclosed by a vertical plane located 50 m from each side of a line of railway and measured horizontally at right angles to the nearest rail.

Le présent règlement s’applique au propriétaire, au locataire ou à l’exploitant d’une installation non ferroviaire qui construit, modifie ou exploite après l’entrée en vigueur du présent règlement une installation non ferroviaire dans l’espace délimité par un plan vertical situé à 50 m de chaque côté d’une voie ferrée, mesuré horizontalement et perpendiculairement au rail le plus proche.

13 (1) Where a proposed railway work consists of the construction or alteration, in the interest of safe railway operations, of a grade separation, the proponent may file an application with the Minister for a grant in respect of that proposed railway work.
13 (1) Lorsque les installations ferroviaires projetées consistent en la construction de sauts-de-mouton ou en la modification de ceux-ci, pour des raisons de sécurité ferroviaire, le promoteur peut déposer auprès du ministre une demande de subvention à cet égard.
