1. Without prejudice to the provisions of Article 25 of this Convention and subject to paragraph 2 below, the limits of liability prescribed in Articles 21, 22 and 23 shall be reviewed by the Depositary at five-year intervals, the first such review to take place at the end of the fifth year following the date of entry into force of this Convention, or if the Convention does not enter into force within five years of the date it is first open for signature, within the first year of its entry into force, by reference to an inflation factor which corresponds to the accumulated rate of inflation since the previous revision or in the first instance since the date of entry into force of the Convention.

(2) (a) Where, prior to the entry into force of this Agreement, a worker other than a worker referred to in Article VI, who is subject to the legislation of one Party and who is employed by an employer having his place of business in the territory of that Party has been sent by that employer to work in the territory of the other Party, he shall after the entry into force of this Agreement be entitled to choose within three months of such entry into force that the legislation of one Party or the other shall apply to him in respect of such employement; and if he chooses to be covered under the legislation of the first Party, then the legislation of that Party shall apply to him for a period of up to 24 months; and if he chooses to be covered under the legislation of the second Party, then the legislation of that Party shall apply to him; and in either case his choice shall take effect from the day on which he gives notice to the appropriate competent authority.
(2) a) Lorsque, avant l’entrée en vigueur du présent Accord, un travailleur, autre que le travailleur décrit à l’Article VI, assujetti à la législation d’une Partie et au service d’un employeur ayant sa place d’affaires sur le territoire de ladite Partie, a été détaché par ledit employeur sur le territoire de l’autre Partie pour y travailler, il pourra, dans les trois mois suivant l’entrée en vigueur du présent Accord, décider si c’est la législation de la première ou de la seconde Partie qui doit lui être appliquée relativement à cette relation de travail; s’il décide d’être assujetti à la législation de la première Partie, la législation de ladite Partie lui sera appliquée pendant une période maximale de 24 mois. S’il décide d’être assujetti à la législation de la seconde Partie, la législation de ladite Partie lui sera appliquée. (b) the amount of any benefit which has been determined before the entry into force of this Agreement shall be recalculated and paid with effect from the date of entry into force of this Agreement, provided that the request is submitted within two years from the date of entry into force of this Agreement.

Any Member State that joins the joint actions pursuant to paragraphs 1 and 2 after the entry into force of the joint procurement agreement entered into between the participating Member States and the Commission shall accept the terms and conditions agreed by participating Member States and the Commission in the joint procurement agreement as well as any decisions already adopted under that agreement.

4. Any Member State not participating in the joint action as provided in Article 26(1) and (2), shall inform the Commission of its decision not to participate in the joint action as provided in Article 26(1) and (2) but to appoint its own auction platform pursuant to paragraphs 1 and 2 of this Article within 3 months of the entry into force of this Regulation.
4. In the event that, pending the completion of the procedures necessary for the entry into force of this Agreement, the provisions of certain parts of this Agreement are put into effect by means of an Interim Agreement between the Community and the Republic of Tajikistan, the Parties agree that, in such circumstances, the term ‘date of entry into force of this Agreement’ shall mean the date of entry into force of the Interim Agreement.

4. As regards the entry into force of the EEA Agreement for the Principality of Liechtenstein, the EEA Council : - noted the amendments agreed between Liechtenstein and Switzerland to their Customs Treaty in order to allow the participation of Liechtenstein to the EEA; - reached agreement on the substance of the necessary adaptations to the Protocols and Annexes of the EEA Agreement for the purposes of the application of this Agreement to Liechtenstein, as given in the Annex to the present conclusions; - welcomed the pragmatic solutions found to several complex difficulties in the field of free movement of goods arising from the maintenance by Liechtenstein of its Customs Treaty with Switzerland, albeit in modified form; - recognised the political importance for Liechtenstein of the transitional arrangements already agreed for the free movement of persons, which remains a fundamental element for the EEA, and welcomed the solution found for this question in the form of the Joint Declaration attached to these conclusions; - concluded on that basis that the condition of Article 121(b) of the EEA Agreement, namely that the good functioning of the EEA Agreement will not be impaired by the regional union between Liechtenstein and Switzerland, is fulfilled; - noted that the amendments to the Customs Treaty between Liechtenstein and Switzerland, together with the Adjusting Protocol to the EEA Agreement, will be subject to ratification in Liechtenstein; - agreed that the formal decision of the EEA Council concerning the entry into force of the EEA Agreement for Liechtenstein should be taken, on this basis, by written procedure as soon as possible in early 1995 ; this decision should enter into force on 1 May 1995, provided that the amendments to the Customs Treaty between Liechtenstein and Switzerland have entered into force at the latest by that date.
4.
