In respect of a PCT national phase application filed before the coming into force of these Rules, the applicant must either comply with the requirements of section 37 of the Patent Rules as they read immediately before the coming into force of these Rules or file a declaration as to the applicant’s entitlement, as at the international filing date, to apply for and be granted a patent, in accordance with Rule 4.17 of the Regulations under the PCT.

3 (1) If letters patent under the Great Seal, other than letters patent that grant or concede lands, or documents under the Privy Seal of the Governor General or person administering the Government of Canada, have been issued to or in the name of the wrong person, or contain any clerical error or misnomer or wrong description of any material fact, the Registrar General of Canada, when authorized by the Governor in Council, may direct that the defective letters patent or documents be cancelled, that a minute of the cancellation be entered in the margin of the registry of the original letters patent or other documents and that correct letters patent under the Great Seal or documents under the Privy Seal be issued in their place.

(2) Money received under Rules 15 and 57 of the Regulations under the PCT shall be deposited in the account entitled the Patent Cooperation Treaty Fund within the account entitled the Canadian Intellectual Property Office Revolving Fund and shall be paid out of that account for purposes in accordance with those Rules.

In this regard, the Commission intends to come forward with a proposal for the creation of a Community supplementary protection certificate extending the protection conferred by Community patents in the way as is the case for national patents under Council regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products [OJ L 182, 2.7.1992, pp. 1-5] and regulation (EC) No 1610/96 of the European Parliament and the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products [OJ L 198, 8.8.1996, pp. 30-35].

To ease the situation, the EPO has decided not to accept from US residents under the PCT treaty any application directed to biotechnology, business methods and telecommunication as from 1 March 2002.

The major reason for this is the large amount of searches that has to be handled by the EPO in the framework of PCT applications. Under the terms of the Patent Co-operation Treaty (PCT), the more than 100 countries that have adhered to this treaty can choose one out of nine international patent offices to perform the search and/or preliminary examination.
