8. Takes note that five Member States have not formally recognised Kosovo, and is of the opinion that further recognitions would help to strengthen stability in the region, to further facilitate the normalisation of relations between Serbia and Kosovo and to increase the EU’s credibility in its external policy; in this regard takes positive note of the decision of the five Member States which have not recognised Kosovo to facilitate the approval of the SAA in the Council; calls on all the Member States to do their utmost to facilitate economic, people-to-people contacts and social relations between their citizens and those of Kosovo, in the spirit of the SAA and the establishment of formal contractual relations; welcomes the submission by Kosovo of the first Economic Reform Programme, which is set to be a first step in deepening its economic dialogue with the EU;

Believes that the conclusion of an FTA would greatly enhance the current relations between the EU Member States and the GCC member states, and would lend added value to the recent Joint Action Programme, in particular, by strengthening capacities and institutions, including within the GCC Secretariat; deplores the fact that the diplomatic presence of the EU in the GCC member states remains minimal and insists that following the establishment of the EEAS the EU should increase its diplomatic presence in the region, including by setting up a Union delegation in each of the six GCC member states, which would work in close cooperation with the national diplomatic services of EU Member States present in the GCC member states, to make the most of their combined expertise concerning the region; believes that a more significant diplomatic presence would greatly increase the chances of a speedy conclusion of the FTA and its subsequent implementation;

3. Without prejudice to their application in relations between Member States and third States, this Framework Decision replaces in relations between Member States which have taken the necessary measures to comply with this Framework Decision and ultimately with effect from 27 April 2012 the provisions of Article 22 of the European Convention on Mutual Assistance in Criminal Matters, as supplemented by Article 4 of said Convention’s additional Protocol of 17 March 1978.
3. Sans préjudice de leur application dans les relations entre États membres et États tiers, la présente décision-cadre remplace, dans les relations entre les États membres ayant pris les mesures nécessaires pour se conformer à la présente décision-cadre et au plus tard à partir du 27 avril 2012, les dispositions de l'article 22 de la Convention européenne d'entraide judiciaire en matière pénale, telles que complétées par l'article 4 du protocole additionnel du 17 mars 1978 à cette convention.

1. Without prejudice to their application in relations between Member States and third States, this Framework Decision shall, from 1 January 2004, replace the corresponding provisions of the following conventions applicable in the field of extradition in relations between the Member States:

(b) The most-favoured-nation treatment referred to in subparagraph (a) shall not apply in respect of trade or economic relations between ACP States or between one or more ACP States and other developing countries.
