Current situation and outlook for the new programming period after 2006. [COM(2004) 580 final - Not published in the Official Journal]. This communication fulfils the commitment given by the Commission in its "Summary of Annual Activity Reports 2002 of DGs and Services" to perform a legal analysis of its responsibilities and those of the Member States in jointly managing the EU budget and clarify the procedures through which, in cooperation with the Member States, it can discharge its general responsibility for implementing the budget.

3. The Court of Auditors and auditors responsible for auditing the budgets of the Union institutions, bodies, offices and agencies established pursuant to the Treaties, and the budgets managed and audited by the institutions, shall disclose to OLAF and to other competent authorities any fact of which they become aware when carrying out their duties, which could be qualified as a criminal offence referred to in Article 3, 4 or 5.

La Cour des comptes et les auditeurs chargés d'une mission d'audit des budgets des institutions, organes et organismes de l'Union institués en vertu des traités, et des budgets gérés et contrôlés par les institutions, révèlent à l'OLAF et aux autres autorités compétentes tout fait dont ils ont pris connaissance dans l'exercice de leur mission qui pourrait être considéré comme une infraction pénale visée aux articles 3, 4 ou 5.

If the Court of Auditors and auditors responsible for auditing the budgets of the EU institutions, bodies, offices and agencies or other budgets managed and audited by the institutions, find anything that could qualify as a criminal offence under this directive, they must inform the European Public Prosecutor’s Office, OLAF and the other competent authorities.
La Cour des comptes et les auditeurs chargés d’une mission d’audit des budgets des institutions, organes et organismes de l’Union et des budgets gérés et contrôlés par les institutions, doivent révéler au Parquet européen, à l’Office européen de lutte antifraude (OLAF) et aux autres autorités compétentes tout fait dont ils ont pris connaissance qui pourrait être considéré comme une infraction pénale au sens de cette directive.

2a. The European Court of Auditors, national audit institutions (e.g. when auditing transactions under shared management arrangements) and auditors responsible for auditing the budgets of the institutions, bodies and agencies established pursuant to the Treaties, or the budgets managed and audited by the institutions, shall disclose to OLAF any criminal offences of which they become aware during their mission and shall be held criminally liable if they fail to do so; moreover, this disclosure shall not render them liable to prosecution;

3. As regards the decentralised agencies, the two arms of the budgetary authority remind the Executive Directors and Management Boards of those agencies of their responsibility to present realistic budget demands, in line with real needs and avoiding over-budgeting.

C. whereas, although the Commission alone is responsible for implementing the budget and so has sole responsibility as far as the discharge of the budget is concerned under the Treaty; nevertheless, 80% of the budget is managed by the Member States, who in actual fact share a large proportion of the responsibility for ensuring correct implementation of the budget and effective use of resources,
