IN-CONTEXT TRANSLATIONS

Regulation (EU) No 912/2010 should be aligned with the principles contained in the common approach of the European Parliament, the Council and of the Commission to the decentralised agencies, adopted by the three institutions on 5 July, 26 June and 12 June 2012 respectively, particularly with regard to the rules for adopting decisions of the Administrative Board, the terms of office of the members of the Administrative Board and of the Security Accreditation Board and those of their chairpersons, the existence of a multiannual work programme, the powers of the Administrative Board concerning staff management, assessment and revision of that Regulation, prevention and management of conflicts of interest and handling of non-classified but sensitive information.
En outre, il y a lieu d’aligner le règlement (UE) no 912/2010 sur les principes qui figurent dans l’approche commune au Parlement européen, au Conseil et à la Commission sur les agences décentralisées, adoptée par ces trois institutions respectivement les 5 juillet, 26 juin et 12 juin 2012, particulièrement en ce qui concerne les règles d’adoption des décisions du conseil d’administration, le mandat des membres du conseil d’administration et du conseil d’homologation de sécurité ainsi que celui de leurs présidents, l’existence d’un programme de travail pluriannuel, les pouvoirs du conseil d’administration en matière de gestion de personnel, d’évaluation et de révision dudit règlement, de prévention et de gestion des conflits d’intérêts et de traitement des informations non classifiées mais sensibles.

Article 5 of the Staff Regulations of Officials of the European Union, in the version resulting from Council Regulation (EC, Euratom) No 723/2004 of 22 March 2004 amending the Staff Regulations of officials of the European Communities and the Conditions of Employment of other servants of the European Communities, as last amended by Council Regulation (EU) No 1240/2010 of 20 December 2010 (‘the Staff Regulations’) reads as follows:
L’article 5 du statut des fonctionnaires de l’Union européenne, dans sa version issue du règlement (CE, Euratom) no 723/2004 du Conseil, du 22 mars 2004, modifiant le statut des fonctionnaires des Communautés européennes ainsi que le régime applicable aux autres agents de ces Communautés, tel que modifié en dernier lieu par le règlement (UE, Euratom) no 1240/2010 du Conseil, du 20 décembre 2010 (ci-après le « statut »), est libellé comme suit :

In order to ensure open and transparent employment conditions and equal treatment of staff, the Staff Regulations of Officials of the European Union (Staff Regulations of Officials) and the Conditions of Employment of Other Servants of the European Union (Conditions of Employment), laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (together referred to as the ‘Staff Regulations’), should apply to the staff and to the Executive Director of the Agency, including the rules of professional secrecy or other equivalent duties of confidentiality.
Afin de garantir des conditions d’emploi ouvertes et transparentes et l’égalité de traitement du personnel, le statut des fonctionnaires de l’Union européenne (ci-après dénommé «statut des fonctionnaires») et le régime applicable aux autres agents de l’Union (ci-après dénommé «régime»), fixés par le règlement (CEE, Euratom, CECA) no 259/68 du Conseil (ci-après dénommés conjointement «statut») devraient s’appliquer au personnel et au directeur exécutif de l’agence, y compris les règles relatives au secret professionnel ou à toute autre obligation de confidentialité équivalente.

1. The Staff Regulations of Officials of the European Communities and the Conditions of Employment of Other Servants of the European Communities laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (the Staff Regulations) and the rules adopted jointly by the Union's institutions for the purpose of applying these Staff Regulations and Conditions of Employment shall apply to the staff of the Support Office, including the Executive Director.

Le statut des fonctionnaires des Communautés européennes et le régime applicable aux autres agents des Communautés européennes, fixés par le règlement (CEE, Euratom, CECA) no 259/68 (ci-après dénommé le «statut») et les règles adoptées conjointement par les institutions de l'Union aux fins de l'application dudit statut et dudit régime s'appliquent au personnel du Bureau d'appui, y compris le directeur exécutif.

In addition to the functions conferred upon the Committee by these Staff Regulations, it may put forward suggestions for revising the Staff Regulations.
Indépendamment des fonctions qui lui sont attribuées par le présent statut, le comité peut formuler toute suggestion en vue de la révision du statut.

The Committee shall be consulted by the Commission on all proposals to revise the Staff Regulations; it shall deliver its opinion within the time set by the Commission.

3. The preceding paragraph shall not apply to a contract staff member who, in the three months following application of the Staff Regulations to him, asks to be allowed to repay such sums plus compound interest at the rate of 3,5 % per year, which may be revised following the procedure laid down in Article 12 of Annex XII to the Staff Regulations.

(1) The overhaul of the current Staff Regulations of officials and Conditions of Employment of other servants of the European Communities, which were originally adopted in 1962, has led to the requirement to phase in certain reform measures: the annual adjustment of pay scales on the basis of the current method, a new special levy and a new pension contribution rate are to take effect as from 1 January 2004, by way of transitional measures, while the revised regulation amending the Staff Regulations is to enter into force on 1 May 2004.
