Although a notice of competition gives unsuccessful candidates the specific right of access to certain information concerning them directly and individually so that they may obtain information and documents enabling them to take an informed decision as to whether it is appropriate to challenge a decision to exclude them from the competition, strict observance by the European Personnel Selection Office (EPSO) of that right, both as regards the substance of that right and in respect of the time-limit for responding, is the embodiment of the duties which stem from the principle of good administration, the public right of access to documents and the right to an effective remedy, in accordance with Articles 41, 42 and 47 of the Charter of Fundamental Rights of the European Union.

It is clear from the above analysis that strict observance by EPSO of the specific right afforded to candidates, both as regards the substance of that right and in respect of the time-limit for responding, is the embodiment of the duties which stem from the principle of good administration, the public right of access to documents and the right to an effective remedy, in accordance with Articles 41, 42 and 47 of the Charter of Fundamental Rights of the European Union.

Information about rights to be given under this Directive should as a minimum requirement under this Directive include information on the right of access to a lawyer, the right to be informed of the charge and, where appropriate, to be given access to the case-file, the right to interpretation and translation for those who do not understand the language of the proceedings and the right to be brought promptly before a court if the suspected or accused person is arrested. This is without prejudice to information to be given on other procedural rightsstemming from the Charter, the ECHR, the ICCPR and applicable EU legislation as interpreted by the relevant courts and tribunals.

5. An employed person who is a national of a Contracting Party and is employed in the territory of the other Contracting Party shall enjoy equal treatment in terms of membership of trade union organisations and exercise of union rights, including the right to vote and right of access to executive or managerial positions within a trade union organisation; he may be precluded from involvement in the management of public law bodies and from holding an office governed by public law.
5. For the purposes of this report, the Commission would draw particular attention to the rights taken from the Treaty establishing the European Community and grouped under Chapter V on citizens' rights: the right to vote and stand as a candidate at elections to the European Parliament (Article 39); the right to vote and stand as a candidate at municipal elections (Article 40); the right of access to documents (Article 42); the right to refer matters to the Ombudsman (Article 43); the right to petition the European Parliament (Article 44); freedom of movement and residence (Article 45); diplomatic and consular protection (Article 46).

(27) Since the European Court of Human Rights has established that irretrievable damage to the rights of the defence results from the use of an incriminating statement made by the suspect or accused person without access to a lawyer, Member States should be required in principle to prohibit the use of any statements given in breach of the right of access to a lawyer as evidence against the suspect or accused person unless the use of such evidence would not prejudice the rights of the defence.
(27) La Cour européenne des droits de l'homme ayant déclaré qu'une atteinte irrémédiable est portée aux droits de la défense lorsque des déclarations incriminantes faites par la personne soupçonnée ou poursuivie sans assistance possible d'un avocat sont utilisées pour fonder une condamnation à son encontre, les États membres devraient, en principe, être tenus d'interdire que soient utilisées comme preuves, contre une personne soupçonnée ou poursuivie, des déclarations qu'elles ont faites alors que leur droit d'accès à un avocat n'a pas été respecté, sauf si l'utilisation de ces preuves ne risque pas de porter atteinte aux droits de la défense.
