The processing of personal data for the purposes of Regulation (EC) No 111/2005, as amended by this Regulation, and any delegated and implementing acts adopted pursuant thereto should respect the fundamental right to respect for private and family life recognised by Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms as well as the right to respect for private and family life, and the right to the protection of personal data recognised, respectively, by Articles 7 and 8 of the Charter of Fundamental Rights of the European Union.

This Directive respects the principles recognised by Article 2 TEU, respects fundamental rights and freedoms and observes the principles recognised, in particular, by the Charter, including those set out in Titles II, III, V and VI thereof which encompass, inter alia, the right to liberty and security, freedom of expression and information, freedom of association and freedom of thought, conscience and religion, the general prohibition of discrimination, in particular on grounds of race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, the right to respect for private and family life and the right to protection of personal data, the principles of legality and proportionality of criminal offences and penalties, covering also the requirement of precision, clarity and foreseeability in criminal law, the presumption of innocence as well as freedom of movement as set out in Article 21(1) of the Treaty on the Functioning of the European Union (TFEU) and in Directive 2004/38/EC of the European Parliament and of the Council .

It respects the fundamental rights and observes the principles recognised in particular by the Charter, in particular the principle of non-discrimination, the right to life and integrity of the person, the right to respect for private and family life, the rights of the child, the right of defence and the right to a fair trial.

(3) Notwithstanding subsection (2), no right in respect of which that subsection applies shall have priority over and be valid against any other right in respect of which that subsection applies but in respect of which an instrument is not registered within the period referred to in that subsection, where the person claiming the right in respect of which an instrument is registered within that period acquired such right with actual knowledge of the other right.
(3) Par dérogation au paragraphe (2), aucun droit qui y est visé ne peut avoir priorité sur tout autre droit, visé par le même paragraphe, ni lui être opposable, mais à l’égard duquel aucun acte n’est enregistré dans le délai visé au même paragraphe, lorsque la personne qui le revendique l’a acquis alors qu’elle connaissait l’existence de l’autre droit.

(3) Notwithstanding subsection (2), no right in respect of which that subsection applies shall have priority over and be valid against any other right in respect of which that subsection applies but in respect of which an instrument is not registered within the period referred to in that subsection, where the person claiming the right in respect of which an instrument is registered within that period acquired that right with actual knowledge of the other right.

This Directive does not affect the possibility for Member States to determine by law, by regulation or by any other specific mechanism to that effect, rightholders’ fair compensation for exceptions or limitations to the reproduction right provided for in Directive 2001/29/EC of the European Parliament and of the Council and rightholders’ remuneration for derogations from the exclusive right in respect of public lending provided for in Directive 2006/115/EC of the European Parliament and of the Council applicable in their territory as well as the conditions applicable for their collection.
La présente directive n’affecte pas la possibilité, pour les États membres, de déterminer par la voie législative ou réglementaire, ou par tout autre mécanisme spécifique prévu à cet effet, une compensation équitable des titulaires de droits pour les exceptions ou les limitations au droit de reproduction prévues par la directive 2001/29/CE du Parlement européen et du Conseil et la rémunération des titulaires de droits pour les dérogations au droit exclusif de prêt public prévues par la directive 2006/115/CE du Parlement européen et du Conseil applicables sur leur territoire, ainsi que les conditions applicables à leur perception.

Moreover, according to the Court, although EU law provides for a limitation to the right to equitable remuneration in the case of ‘private use’, it does not allow Member States to exempt a hotel operator which makes a ‘communication to the public’ of a phonogram from the obligation to pay such remuneration.
De surcroît, selon la Cour, si le droit de l’Union limite le droit à une rémunération équitable en cas d’« utilisation privée », il ne permet pas aux États membres d’exonérer l’exploitant d’un établissement hôtelier, qui réalise un acte de « communication au public » d’un phonogramme, de l’obligation de verser une telle rémunération.
