The agreement forced SHG to supply all its electricity solely to EDF at French prices and on French conditions for resale to ENEL, preventing SHG from selling its electricity direct to ENEL or negotiating prices in line with conditions on the Italian market; this situation was not in any way justified by - 2 - exclusive rights enjoyed by the EDF monopoly.

In April 1991 the "Société Hydroélectrique de Grangevieille (SHG)" lodged a complaint against EDF and ENEL concerning the purchasing conditions imposed on it by EDF and ENEL.
