42 (1) Where the Crown has contracted with any person for the construction or execution of any public work, or where, by direction of the Governor in Council, or of a Minister within the scope of the powers of the Minister, any officer, employee or agent of the Crown is charged with the construction or execution of any public work, the Governor in Council may, if in the opinion of the Governor in Council it is necessary or expedient that any material be excavated or removed by blasting or the use of explosives, authorize the work to be performed in that manner, notwithstanding that the blasting or explosions may cause damage to land or other property or to the prosecution of any industry or work that is situated in the vicinity of the work or that may be thereby affected.

Notes that completion of the internal market is essential to the competitiveness and growth of European industry; stresses that European industries need a proper framework in which to create and develop goods and services at European level, and welcomes in this context the proposals set out in the Single Market Act; calls on the Commission to identify the scope for efficiency-enhancing harmonisation and improved governance within the framework of the Single Market Act, particularly in the fields of VAT, intellectual property rights and the EU patent, global standardisation, labelling and specific sectoral standards;

Within the scope of this Agreement, each Party undertakes to ensure that natural and legal persons of the other Party have access free of discrimination in relation to its own nationals to the competent courts and administrative organs of the Parties to defend their individual rights and their property rights, including those concerning intellectual, industrial and commercial property.

(13) It is necessary to define the scope of this Directive as widely as possible in order to encompass all the intellectual and industrial property rights covered by Community provisions in this field and by the resulting national provisions, while excluding patents and certain activities which do not involve intellectual property in the strict sense.

Its objective is clear and its scope considerable: to encourage our financial institutions to become better acquainted with this industry and devote more of their resources to funding Canadian production and distribution companies. It cannot be used in a way that denies the provincial legislatures the power to regulate local matters and industries within their boundaries. Nor can the power of the provinces to regulate property and civil rights within the provinces deprive the federal Parliament of its powers under s. 91(2) to legislate on matters of genuine national importance and scope—matters that transcend the local and concern Canada as a whole.
