Moreover, in accordance with Article 3 of Commission Regulation (EC) No 1681/94 of 11 July 1994 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the structural policies and the organisation of an information system in this field , if in the light of the circumstances of these accidents the Greek authorities conclude that the expenditure on helicopters constitutes an irregularity because of deficiencies in the tendering or contracting process (as distinct from operational issues), it is the Member State's responsibility to communicate to the Commission this irregularity, and this before the submission of the final payment claim for the related programme ("Health and welfare").
Par ailleurs, conformément à l'article 3 du règlement (CE) n° 1681/94 de la Commission, du 11 juillet 1994, concernant les irrégularités et le recouvrement des sommes indûment versées dans le cadre du financement des politiques structurelles ainsi que l'organisation d'un système d'information dans ce domaine , si au vu des circonstances entourant ces accidents, les autorités grecques arrivent à la conclusion que les dépenses concernant l'achat d'hélicoptères constituent un cas d'irrégularité du fait de vices au niveau de l'appel d'offres ou de l'adjudication du contrat (à distinguer de problèmes purement opérationnels), il revient à l'État membre de notifier ce cas d'irrégularité à la Commission, et cela avant présentation de la demande de paiement final pour le programme concerné ("Santé et bien-être").
