The Commission has informed the European Parliament and the European Economic and Social Committee, in accordance with its communication of 14 December 1993 concerning the application of the Agreement on Social Policy, by sending them the text of its proposal for a Directive containing the Agreement.

WISHES that the new legal base of the Agreement of the Eleven on social policy should as far as possible be employed only when the other avenues and possibilities for an agreement covering Twelve Member States have been fully explored; 13. TAKES THE VIEW that, in order to develop further the core of minimum standards, the two sides of industry should make their own active contributions to the finding of practical solutions; 14. EMPHASIZES that, when proposals for minimum standards are being drawn up by the Commission and when such standards are being laid down by the Council, the impact on employment and on small and medium-sized enterprises should in particular be assessed; 15. RECALLS that several Member States have already submitted specific suggestions for minimum standards in the form of contributions to the Green Paper on European social policy; while others have also cited areas in this connection in which the Union should not intervene; EXPECTS the Commission to give all suggestions careful consideration in the context of the planned new work programme; Respecting the principles of subsidiarity and proportionality 16.

EST D'AVIS que les partenaires sociaux devraient apporter leurs contributions actives à l'aménagement du socle de normes minimales afin de trouver des solutions pragmatiques ; 14. SOULIGNE qu'il conviendrait, lors de l'élaboration de propositions de normes minimales par la Commission, ainsi que lors de la fixation de celles-ci par le Conseil, d'en apprécier tout particulièrement les répercussions sur l'emploi et sur les petites et moyennes entreprises ; 15. RAPPELLE que plusieurs Etats membres ont présenté, à titre de contribution au Livre vert sur la politique sociale européenne, des propositions concrètes de normes minimales et que d'autres ont, par contre, cité à cet égard des domaines dans lesquels l'Union ne devrait pas intervenir ; ESCOMPTE que la Commission examinera attentivement toutes les suggestions concernant le nouveau programme de travail annoncé ; Respecter les principes de subsidiarité et de proportionnalité 16.

The final decision about which procedure to follow will therefore be based on the following elements: - the nature of the proposal, - the attitude of the social partners towards the proposal, - the need to progress the social dimension at the same pace as other policies, and therefore, the possibility for the Council to decide by qualified majority, - the desire to ensure that all workers throughout the Community benefit from the proposed measure, - the prospects of being able to make progress amongst the twelve (1) COM(93)600 While the Agreement on Social Policy is an important stage in the development of European Social Policy, Mr Flynn said that he hoped that this would only be a transitional stage and that there will be agreement at the next Inter-Governmental Conference in 1996 that these provisions can be incorporated into one Treaty, which will apply in all Member States.

Flynn a déclaré que, bien que l'Accord sur la politique sociale constitue une étape importante du développement de la politique sociale, il espère qu'il ne s'agira que d'une étape transitoire et que, lors de la prochaine conférence intergouvernementale prévue pour 1996, il y aura un accord pour inclure ces dispositions dans un traité unique applicable à tous les Etats membres.

APPLICATION OF THE AGREEMENT ON SOCIAL POLICY The Council took note of the details given by Commissioner FLYNN of the application of the Agreement on Social Policy ("Social Policy for Fourteen") in connection with the two proposals for Directives on: - the burden of proof in cases of sex discrimination and, - part-time, fixed-term and temporary work.
