1. By way of derogation from the first sentence, where the person to whom the act or omission is directly attributable has submitted an aid application or a payment claim in the calendar year concerned or the years concerned, the administrative penalty shall be imposed on the basis of the total amounts of the payments referred to in Article 92 granted or to be granted to that person.

By way of derogation from the second subparagraph, from 2010, where the person to whom the act or omission is directly attributable has submitted an aid application in the calendar year concerned, the reduction or exclusion shall be applied to the total amounts of direct payments granted or to be granted to that person.

17. Where copies of any reports, photographs, maps or other factual material required to be submitted by an applicant or a recipient pursuant to paragraph 4(d) or paragraph 7(1)(d) have previously been submitted to the Director pursuant to any of the Acts or Regulations referred to in section 2, the applicant or recipient, as the case may be, shall, upon so notifying the Director be deemed for the purposes of these Regulations to have submitted them pursuant to paragraph 4(d) or 7(1)(d) as the case may be.
17. (h) are applying as a trader or investor, intra-company transferee or professional, as described in Section B, C or D of Annex 1603 of the Agreement, within the meaning of subsection 2(1) of the North American Free Trade Agreement Implementation Act, and their country of citizenship — being a country party to that Agreement — grants to Canadian citizens who submit a similar application within that country treatment equivalent to that accorded by Canada to citizens of that country who submit an application within Canada, including treatment in respect of an authorization for multiple entries based on a single application; or

Section 55 of the Firearms Act is adapted by adding the requirement that, in determining whether an Aboriginal applicant is eligible to hold a licence under section 5 of that Act, a chief firearms officer shall consider any recommendations submitted by the applicant from an elder or leader of the applicant’s Aboriginal community regarding the importance to the applicant of engaging in traditional hunting practices.
8. 4 (1) Where the applicant making or proceeding with the application is acting on behalf of an interested party, the original or a certified true copy of the document that authorizes the applicant to act for the interested party shall, in addition to the documents that may be required pursuant to subsection 3(2), be submitted to the Minister.
