7 (1) Where the evidence upon a trial before a Summary Conviction Court was taken by a stenographer duly sworn or by a sound recording apparatus, unless a Judge of the Appeal Court otherwise orders, the Summary Conviction Court shall deliver to the Clerk for the use of the Appeal Court, a transcript of the evidence taken at the Summary Conviction Court, and the reasons for judgment and/or sentence, if any.

(2) Subject to these rules, where the evidence at the trial in the summary conviction court was taken by a court reporter duly sworn or was recorded by a sound recording apparatus, the appellant shall, when he files a notice of appeal, file with the Registrar a certificate of the court reporter in the summary conviction court, in Form 3 in the schedule to these rules, that four copies of the transcript of the evidence taken in the summary conviction court and of the reasons for judgment and sentence have been ordered and will be provided.
(2) Sous réserve des présentes règles, lorsque les témoignages entendus au cours du procès qui s’est déroulé devant la cour des poursuites sommaires ont été recueillis par un sténographe judiciaire dûment assermenté ou au moyen d’un appareil d’enregistrement sonore, l’appelant doit, au moment du dépôt de son avis d’appel, déposer auprès du registraire un certificat du sténographe judiciaire de la cour des poursuites sommaires établi conformément à la Formule 3 qui figure à l’annexe des présentes règles attestant que quatre copies de la transcription des témoignages recueillis devant cette cour et des motifs du jugement et de la sentence ont été demandées et seront fournies.

821 (1) Where a notice of appeal has been given in accordance with the rules referred to in section 815, the clerk of the appeal court shall notify the summary conviction court that made the conviction or order appealed from or imposed the sentence appealed against of the appeal and on receipt of the notification that summary conviction court shall transmit the conviction, order or order of dismissal and all other material in its possession in connection with the proceedings to the appeal court before the time when the appeal is to be heard, or within such further time as the appeal court may direct, and the material shall be kept by the clerk of the appeal court with the records of the appeal court.

(3.1) Before making an order under subsection (3), the justice or the summary conviction court shall consider whether it is desirable, in the interests of the safety of the defendant or of any other person, to include as a condition of the recognizance that the defendant be prohibited from possessing any firearm, cross-bow, prohibited weapon, restricted weapon, prohibited device, ammunition, prohibited ammunition or explosive substance, or all such things, for any period specified in the recognizance and, where the justice or summary conviction court decides that it is so desirable, the justice or summary conviction court shall add such a condition to the recognizance.
