Therefore, they said that what they will do is say to all foreign banks with a banking institution within their territory that they will have to comply in their home country subsidiary to the taxation information and law in the U.S. with regard to information for citizens — not residents, citizens.

That strategy is used by investors primarily to mitigate risk and to deal with the limited amount of direct information available from any single individual company. Those portfolio investments, if done directly, are subject to significant restrictions both in terms of taxation and of approvals from the Reserve Bank of India.

Recalls in this context that it is of primary importance to put an end to the use of artificial legal persons as a way to avoid taxation; stresses also that instead of bank secrecy, automatic information exchange should take place in all circumstances, including in all the Member States and dependent territories; welcomes in this respect the Commission's proposal on administrative cooperation in the field of taxation because, inter alia, it extends cooperation between the Member States to cover taxes of any kind, abolishes bank secrecy and establishes the automatic exchange of information as a general rule;

In particular, regrets that the G20 did not confirm the end of banking secrecy, which is used as a shield for tax evaders; stresses also that instead of banking secrecy, automatic information exchanges should occur in all circumstances, including between all EU countries and dependent territories; supports the Commission proposal to introduce automatic information exchange as a rule for administrative cooperation in the field of taxation; calls for the Commission to be given a greater role in designing the EU strategy against tax havens at a global level;

(4e) Nevertheless, consideration needs to be given to the needs of the banking sectors of some Member States and their structural differences by allowing them to have a transitional period during which they will levy a withholding tax, at a rate increasing progressively to 35%; until full information exchange is achieved this will ensure a minimum level of effective taxation; the greater part of this revenue should be transferred to the Member State of residence of the beneficial owner of the interest.
(4 sexies) Il faut néanmoins prendre en compte les besoins des secteurs bancaires de certains États membres ainsi que leurs différences structurelles en leur octroyant une période de transition durant laquelle ils pourront appliquer une retenue fiscale à la source, à un taux atteignant progressivement 35%. These include: * the refusal of financial service providers to sell financial services to non-residents * limits imposed by host Member States on the range of services that can be offered (e.g. one Member State does not allow interest-bearing current accounts) * poor quality of service * lack of information and professional advice (particularly concerning the banking sector) * fraudulent activities of unregulated intermediaries (who often charge excessive fees and offer poor information concerning the products they sell) * difficulties in the enforcement of contracts (both national and cross-border) and interpretation of contracts * lack of harmonisation in taxation (it can be difficult to deduct contributions to life assurance or mortgage loan repayments in another Member State) * motor insurance coverage of victims of an accident involving a vehicle from another Member State but caused by a local vehicle (these fall outside the current green card system, and victims can encounter difficulties obtaining adequate compensation).
