(13) In order to achieve the objective of exchange of information between Member States through interoperable means, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amendments to Annexes I and II of this Regulation in the light of technical progress, in particular, in order to take into account relevant amendments to Directive 1999/37/EC or amendments to other Union acts directly relevant for the updating of Annexes I and II of this Regulation, in respect of the conditions which should be met by undertakings using professional vehicle registration certificates in order to satisfy the requirements of a good reputation and the requisite professional competence, and in respect of the duration of the validity of the professional vehicle registration certificates.
(13) Afin de réaliser l'objectif d'un échange d'informations entre les États membres grâce à des moyens interopérables, le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne devrait être délégué à la Commission en vue de l'adoption de modifications aux annexes I et II du présent règlement pour les adapter au progrès technique, afin notamment de tenir compte des modifications pertinentes apportées à la directive 1999/37/CE ou à d'autres actes de l'Union directement applicables en ce qui concerne la mise à jour des annexes I et II du présent règlement, ainsi qu'en vue de la définition des conditions que doivent remplir les entreprises utilisant des certificats d'immatriculation professionnels pour satisfaire aux exigences en matière de bonne réputation et de compétences professionnelles et en vue de la détermination de la durée de validité des certificats d'immatriculation professionnels.

(6) Technical roadside inspections should therefore be implemented via a risk rating system based on the number and severity of deficiencies found on vehicles operated by individual undertakings as stated in standardised roadworthiness certificates and roadside inspection reports.

In order to obtain the safety certificate, the railway undertaking shall comply with the regulations under national law, compatible with Community law and applied in a non-discriminatory manner, laying down the technical and operational requirements specific to rail services and the safety requirements applying to staff, rolling stock and the undertaking's internal organisation.

These exclusive rights limiting access to the market also have the effect of restricting or preventing, to the detriment of users, the use of satellite communications that could be offered, thereby holding back technical progress in this area. Because their investment decisions are likely to be based on exclusive rights, the undertakings concerned are often in a position to decide to give priority to terrestrial technologies, whereas new entrants might exploit satellite technology. The telecommunications organizations have generally given preference to the development of optical-fibre terrestrial links, and satellite communications have been used chiefly as a technical solution of last resort in cases where the cost of the terrestrial alternatives has been prohibitive, or for the purpose of data broadcasting and/or television broadcasting, rather than being used as a fully complementary transmission technology in its own right. Thus the exclusive rights imply a restriction on the development of satellite communication, and this is incompatible with Article 90 of the Treaty, read in conjunction with Article 86.
