However, in the context of the sale of intervention butter, if the tender states, in accordance with Article 22(2)(e), that incorporation of the butter into final products or, where applicable, manufacture of concentrated butter or addition of tracers to butter, or manufacture of intermediate products, will take place in a Member State other than the Member State in which the tender has been submitted, the security may be lodged with the competent authority designated by the other Member State, which shall issue to the tenderer the proof referred to in Article 21(1)(e).

During the manufacture of concentrated butter as referred to in point (b) of the first subparagraph of Article 5(1), whether or not tracers are added, and during the manufacture of milkfat as referred to in Article 5(2), or during the processing of intervention butter into concentrated butter in accordance with Article 7, or during the addition of tracers to cream, intervention butter or butter, or during repackaging as referred to in the second subparagraph of Article 9(2), the competent agency shall carry out unannounced on-the-spot checks on the basis of the establishment's manufacturing programme referred to in Article 13(1)(h) in such a way that each tender referred to in Article 20 is checked at least once and, in the case of milkfat intended for use in the manufacture of concentrated butter, at least once a month.

Lors de la fabrication du beurre concentré visé à l'article 5, paragraphe 1, premier alinéa, point b), additionné ou non des traceurs et lors de la fabrication de la MGL visée à l'article 5, paragraphe 2, ou lors de la transformation du beurre d'intervention en beurre concentré conformément à l'article 7, ou lors de l'addition des traceurs à la crème, au beurre d'intervention ou au beurre, ou lors du reconditionnement visé à l'article 9, paragraphe 2, deuxième alinéa, l'organisme compétent assure des contrôles inopinés sur place en fonction du programme de fabrication de l'établissement, visé à l'article 13, paragraphe 1, point h), de sorte que chaque offre visée à l'article 20 fasse l'objet d'un contrôle au moins et, en ce qui concerne la MGL destinée à la fabrication de beurre concentré, au minimum une fois par mois.

Buying-in through special measures acting as a safety net is not public intervention as it is generally known, but rather a system providing for buying-in by tender, which is to say an auction procedure that would only lower prices that had already slumped of their own accord to the level set in the proposal.

(5) Whereas the implementation of an intervention system for butter should maintain the competitive position of butter on the market and provide for the most efficient possible storage; whereas the quality requirements to be observed in respect of butter constitute a determining factor for attaining these objectives; whereas buying into intervention should take place in so far as it is necessary to maintain the stability of the market by reference to the market price of butter in the Member States, and should be carried out under a tendering procedure;
(5) considérant que la mise en oeuvre du régime d'intervention pour le beurre devrait maintenir la position concurrentielle du beurre sur le marché et permettre un stockage aussi rationnel que possible; que les exigences de qualité auxquelles doit répondre le beurre constituent un facteur déterminant dans la réalisation de ces objectifs; que les achats à l'intervention devraient avoir lieu dans la mesure nécessaire au maintien de la stabilité du marché par référence au prix de marché du beurre dans les États membres et devraient être effectués par voie d'adjudication;

(7) Whereas in addition to intervention in respect of butter and fresh cream, other Community intervention measures are required to enable the best return to be obtained from milk proteins and to support the prices of products which have special importance in determining producer prices for milk; whereas these measures should take the form of buying-in of skimmed milk powder and of granting private storage aid for this product; whereas, however, the normal buying into intervention of skimmed milk powder may be suspended when a certain quantity is reached and may be replaced by buying-in under a tender procedure;
(7) considérant que, outre les interventions pour le beurre et la crème fraîche, il est nécessaire de prévoir d'autres mesures d'intervention communautaires visant à soutenir la valorisation des protéines du lait et les prix des produits dont le rôle dans la formation des prix à la production du lait est particulièrement important; que ces mesures devraient prendre la forme d'achats de lait écrémé en poudre et d'octroi d'aides au stockage privé de ce produit; que, toutefois, les achats normaux à l'intervention de lait écrémé en poudre peuvent être suspendus à partir d'une certaine quantité et peuvent être remplacés par des achats effectués par voie d'adjudication;

Measures now adopted As at the present time more than 180 000 tonnes of butter have been bought in, the Commission, having consulted the Managemet Committee for Milk Products, has decided: - to suspend, as from 29 June, for the entire Community, the buying-in of butter at the intervention price, and accordingly, - to open the permanent tender procedure for buying in butter, - to adapt payment scheduling and to discontinue the time periods for taking over butter.
