The Republic of Austria objects to the Federal Republic of Germany characterising the income at issue as interest with a ‘profit participation’ element within the meaning of Article 11(2) of the German-Austrian Double Taxation Convention.
La République d’Autriche reproche à la République fédérale d’Allemagne de qualifier les revenus litigieux comme des intérêts «avec participation aux bénéfices» au sens de l’article 11, paragraphe 2, de la Convention préventive de la double imposition entre l’Autriche et l’Allemagne.

Contrary to the position of the Federal Republic of Germany, the Republic of Austria takes the view that the certificates at issue confer solely an entitlement to interest calculated on the basis of a fixed percentage of the nominal value.
