The Court ruling follows an application for judicial review that was first submitted by IATA (International Air Transport Association), ELFAA (European Low Fares Airline Association) and Hapag-Lloyd Express, to the High Court of Justice of England and Wales, claiming that the EU Regulation on air passenger rights was invalid on several grounds.
L’arrêt de la Cour fait suite à la demande de contrôle juridictionnel présentée par l’International Air Transport Association (IATA), la European Low Fares Airline Association (ELFAA) et Hapag-Lloyd Express auprès de la High Court of Justice of England and Wales, qui ont fait valoir l’invalidité à plusieurs titres du règlement communautaire relatif aux droits des passagers .

Mr Van Miert noted that liberalization had been a gradual process, with the adoption by the Council of: - a first package of measures in December 1987, which brought in flexible pricing, abandoned the principle of strict capacity sharing and started liberalizing access to the market (multiple designation, fifth freedom) whilst applying the rules of competition, - a second package in June 1990, which reinforced those of the first package by further liberalizing capacity sharing, facilitating market access and giving operators greater freedom to set their fares. 1 COM(91)275. -2- This final package, presented just one year after the adoption of the preceding one, puts the finishing touches to the organization of air transport in an integrated market.
