As a general rule, a treaty provides an institutional framework in which the parties try to avoid that kind of litigation and work out their differences in the institutional framework set out in the treaty.

The principles set out in the Communication are based on the Treaty and on the case law of the Court of Justice, which remains of course the sole competent institution to provide a definitive interpretation of Community law.
