The Commission has received a mandate from Council to conclude an open skies agreement with the USA, to conclude a broad agreement with the EU's neighbours in the European Common Aviation Area (ECAA) and a horizontal mandate to negotiate horizontal agreements with third countries which take into account the EU single aviation market and permit all EU airlines to operate on the routes concerned on a non-discriminatory basis.
La Commission a reçu un mandat du Conseil pour conclure un accord "ciel ouvert" avec les États-Unis et conclure un large accord avec les voisins de l'UE dans l'Espace aérien européen commun (EAEC) ainsi qu'un mandat horizontal pour négocier avec des pays tiers des accords horizontaux qui tiennent compte du marché unique de l'aviation de l'UE et permettent à l'ensemble des transporteurs aériens de l'UE d'opérer sur les itinéraires concernés sur une base non discriminatoire.

1. A Member State, following consultations with the other Member States concerned and after having informed the Commission, the airports concerned and air carriers operating on the route, may impose a public service obligation in respect of scheduled air services between an airport in the Community and an airport serving a peripheral or development region in its territory or on a thin route to any airport on its territory any such route being considered vital for the economic and social development of the region which the airport serves.

Un État membre peut, à la suite de consultations avec les autres États membres concernés et après en avoir informé la Commission, les aéroports concernés et les transporteurs aériens qui exploitent la liaison, imposer une obligation de service public au titre de services aériens réguliers entre un aéroport situé dans la Communauté et un aéroport desservant une zone périphérique ou de développement située sur son territoire ou sur une liaison à faible trafic à destination d'un aéroport situé sur son territoire, si cette liaison est considérée comme vitale pour le développement économique et social de la région desservie par l'aéroport.

2. In instances where other modes of transport cannot ensure an uninterrupted service with at least two daily operations , the Member States concerned may include in the public service obligation the requirement that any air carrier intending to operate the route gives a guarantee that it will operate the route for a certain period, to be specified, in accordance with the other terms of the public service obligation.

Au cas où d'autres modes de transport ne peuvent assurer un service continu avec au moins deux exploitations quotidiennes, les États membres concernés peuvent prévoir, dans le cadre des obligations de service public, que tout transporteur aérien qui compte exploiter la liaison est tenu de garantir qu'il l'exploitera pendant une certaine période, à fixer, conformément aux autres éléments de l'obligation de service public.

If, by 1.3.2006, no air carrier has declared to the Civil Aviation Authority that it intends to operate scheduled flights on one or more of the above routes from 1.4.2006 in accordance with the stipulations of the public service obligation for the route or routes concerned and without financial compensation, Greece has decided that, under the procedure laid down in Article 4(1)(d) of the said Regulation, it will initiate the procedure to limit access to one or more of the above routes (as stated in the next article) to a single air carrier for 3 years and to offer the right to operate the routes concerned from 1.4.2006 by public tender.
Si, au 1er mars 2006, aucun transporteur aérien n'a notifié au Service de l'aviation civile son intention d'effectuer, à partir du 1er avril 2006, conformément aux obligations de service public imposées et sans compensation financière, des vols réguliers sur une ou plusieurs des liaisons susmentionnées, la Grèce a décidé, dans le cadre de la procédure prévue à l'article 4, paragraphe 1, point d), dudit règlement, d'en limiter l'accès pendant trois ans à un seul transporteur aérien (conformément à l'article suivant) et d'octroyer, à l'issue de cet appel d'offres, le droit d'exploiter ces liaisons à partir du 1er avril 2006.

If the reserved slots on the route concerned are not used, they shall be made available to any other air carrier interested in operating the route in accordance with the public service obligations, subject to paragraph 2.

According to Article 4(1)(a) of the Regulation on access for Community air carriers to intra-Community air routes [55], a Member State, following consultations with the other Member States concerned and after having informed the Commission and air carriers operating on the route, may impose a public service obligation in respect of scheduled air services to an airport serving a peripheral or development region in its territory or on a thin route to any regional airport in its territory, any such route being considered vital for the economic development of the region in which the airport is located, to the extent necessary to ensure on that route the adequate provision of scheduled air services satisfying fixed standards of continuity, regularity, capacity and pricing, which standards air carriers would not assume if they were solely considering their commercial interest.
