BD. whereas during its visit to Washington of 28-31 October 2013 the LIBE delegation met with the US Department of the Treasury; whereas the US Treasury stated that since the entry into force of the TFTP Agreement it had not had access to data from SWIFT in the EU except within the framework of the TFTP; whereas the US Treasury refused to comment on whether SWIFT data would have been accessed outside TFTP by any other US government body or department or whether the US administration was aware of NSA mass surveillance activities; whereas on 18 December 2013 Mr Glenn Greenwald stated before the inquiry held by the LIBE Committee that the NSA and GCHQ had targeted SWIFT networks;

The specific national differences are further reflected in the wide variety of other authorities involved: Federal (criminal) Police, FIUs, Agency for the protection of Counter Terrorism, Border Guards, Provincial Governments, Treasury, anti-fraud Departments or investigation services and judicial authorities.

With the current proposal the Commission envisages an international agreement between the EU and the US, which, based on Articles 216 (international agreements), 82 (judicial cooperation) and 87 (police cooperation) of the Treaty on the Functioning of the European Union, would require transfer to the United States Department of Treasury of relevant financial messaging data which are necessary for the purpose of the US Treasury Department's Terrorist Finance Tracking Programme.

I. whereas any EU-US agreement must be conditional upon maintaining the protection which exists in the memorandum of understanding and the US Treasury representations, such as those that apply in the case of data subpoenaed from SWIFT's US operating centre by the US Treasury Department,

– having regard to the US Terrorist Finance Tracking Program (TFTP) based on US Presidential Executive Order 13224 , which, in the event of a national emergency, authorises notably the US Treasury Department to obtain, by means of "administrative subpoenas", sets of financial messaging data transiting over financial message networks such as the ones managed by the Society for Worldwide Interbank Financial Telecommunications (SWIFT),

The management of this Agreement shall be entrusted to the competent departments of the Commission of the European Communities and, where appropriate, the customs authorities of the Member States on the one hand and the Customs Service (Department of Treasury) of the United States of America on the other.
