(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.
(12) Conformément au protocole intégrant l’acquis de Schengen dans le cadre de l’Union européenne, le présent règlement constitue un développement de l’acquis de Schengen, tel que défini par l’annexe A de la décision 1999/435/CE du Conseil du 20 mai 1999 relative à la définition de l’acquis de Schengen en vue de déterminer, conformément aux dispositions pertinentes du traité instituant la Communauté européenne et du traité sur l’Union européenne, la base juridique de chacune des dispositions ou décisions qui constituent l’acquis.

(11) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark is not taking part in the adoption of this Decision and is not bound by it or subject to its application. Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark has, in accordance with Article 5 of the said Protocol, to decide within a period of six months after the date of adoption of this Decision whether it will implement it in its national law.
Étant donné que la présente décision développe l'acquis de Schengen en application des dispositions de la troisième partie, titre IV, du traité instituant la Communauté européenne, le Danemark, conformément à l'article 5 dudit protocole, décide, dans un délai de six mois après l'adoption la présente décision, s'il la transpose dans son droit national.

(2) The Schengen Information System (or "the SIS"), set up under Title IV of the Convention of 1990 implementing the Schengen Agreement of 14 June 1985 on the gradual abolition of checks at common borders (hereinafter "the 1990 Schengen Convention") and integrated into the framework of the European Union pursuant to the Protocol annexed to the Treaty on European Union and to the Treaty establishing the European Community, constitutes an electronic network between the Member States and contains inter alia data on motor vehicles with a cylinder capacity exceeding 50 cc which have been stolen, misappropriated or lost.
(2) Le Système d'information Schengen (ou "SIS"), créé conformément au titre IV de la convention, conclue en 1990, d'application de l'accord de Schengen du 14 juin 1985 relatif à la suppression graduelle des contrôles aux frontières communes (ci-après dénommée "convention de Schengen de 1990"), intégrée dans le cadre de l'Union européenne conformément au protocole annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, constitue un réseau électronique entre les États membres et contient, entre autres, des données sur les véhicules à moteur d'une cylindrée supérieure à 50 cm qui ont été volés, détournés ou égarés.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.
Le Royaume-Uni participe à la présente décision, conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne et à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen , pour autant que ses mesures développent les dispositions de l'acquis de Schengen afin de lutter contre l'organisation de l'immigration illégale auxquelles le Royaume-Uni participe, et conformément à l'article 3 du protocole sur la position du Royaume-Uni et de l'Irlande annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, ayant notifié son souhait de participer à l'adoption et à l'application de la présente décision.

We are also seeing bilateral or multilateral initiatives and agreements which will lead us goodness knows where, in relation, for example, to the issue of Schengen in the Treaty. We do not know what is going to happen, nor how the work will be done. Schengen has been hijacked by the Member States for the moment.
Par contre, nous voyons les initiatives individuelles des États proliférer, initiatives qui déséquilibrent le programme législatif, quand il ne s’agit pas d’initiatives bilatérales ou multilatérales et d’accords qui vont je ne sais où à propos, par exemple, de Schengen dans le Traité : nous ne savons pas ce qui va se produire ni comment l'on va travailler, Schengen est actuellement pris en otage par les États membres.

9. Calls on the Commission to carry out its role of guardian of the Treaties and observer of the activities of the Schengen Group and to inform Parliament of proposed measures and decisions, both within the context of the third pillar of the Treaty on European Union, and in the context of the working of Schengen;
9. invite la Commission à remplir sa mission de gardienne des traités et d'observatrice des activités du groupe Schengen et à informer le Parlement des mesures et des décisions projetées, à la fois dans le cadre du troisième pilier du traité sur l'Union européenne et du fonctionnement de Schengen;
