It should be noted that, in the opinion of the United Nations Working Group looking into the case of these five Cuban citizens held in the United States of America, their trial did not take place under objective and impartial conditions, the 11th Circuit Court of Appeals in Atlanta deciding unanimously to annul the verdict handed down in Miami.

Following the decision of 27 May 2005 of the UN working group concerning the five Cuban citizens imprisoned in the US, which stated that 'the trial did not take place in a climate of objectivity and impartiality', on 9 August 2005 the US Court of Appeals for the Eleventh Circuit, sitting in Atlanta, decided unanimously to overturn the Miami judgment and annul the convictions of the five, ordering a retrial.
Après la décision du groupe de travail de l’ONU du 27.5.2005, relative aux cinq citoyens cubains détenus aux États-Unis, qui considérait que «le jugement n’avait pas été rendu dans un climat d’objectivité et d’impartialité», la cour d’appel du 11e circuit d’Atlanta, aux États-Unis, a décidé, à l’unanimité, le 9 août dernier, d’annuler le jugement de Miami et donc les condamnations de ces cinq personnes, ordonnant que soit rendu un nouveau jugement.

Another court of appeal in San Francisco has rejected this argument, but this court of appeal is also the court in the United States whose decisions are most often overturned in the Supreme Court, so it is doubtful whether its pronouncement will be of any consequence.

The latter fact has been noted by prominent jurists, the international press and also, today, by the American judge, Mr Calabresi, head of the Court of Appeal in New York, who says that Italy is setting out in the opposite direction to that taken by the United States and the whole international community.
