I. whereas freedom of the press is still under great pressure in Egypt and journalists are still being detained on the basis of unfounded allegations; whereas a number of journalists were prosecuted in 2014 on charges related to threatening national unity and social peace, spreading false news reports and collaborating with the Muslim Brotherhood; whereas the Court of Cassation, Egypt’s highest court of law, ruled that there were procedural failings in the trial of journalists Mohammed Fahmy, Peter Greste and Baher Mohamed from Al-Jazeera; whereas, however, the three journalists are set for retrial and charges of ‘falsifying news’ and ’involvement with the Muslim Brotherhood’ against them have not been dropped; whereas three other journalists – Sue Turton, Dominic Kane and Rena Netjes – were sentenced in absentia to 10 years in prison; whereas Egyptian journalists Mahmoud Abdel Nabi, Mahmoud Abu Zeid, Samhi Mustafa, Ahmed Gamal, Ahmed Fouad and Abdel Rahman Shaheen were convicted for merely carrying out their legitimate activities; whereas there is extreme polarisation of the Egyptian media into pro- and anti-Morsi factions, which is reinforcing the polarisation of Egyptian society;

F. whereas violations of fundamental freedoms and human rights remain widespread in Egypt; whereas violence, incitement and harassment against political opponents, journalists and civil society activists further increased in the run-up to the referendum; whereas many political and civil society activists, including Alaa Abdel Fattah, Mohamed Abdel from the Egyptian Centre for Economic and Social Rights, and Ahmed Maher and Ahmed Douma, leaders of the April 6 movement, as well as members of various political parties, were arrested and convicted over the past weeks; whereas on 12 January 2014 the Egyptian National Council for Human Rights released a report after having visited the aforementioned prominent activists in Tora prison, criticising their conditions of detention and calling for an end to their mistreatment;

D. whereas the Constitutional Declaration issued on 8 July 2013 defined a roadmap with parliamentary elections taking place before the presidential one, while the constitution does not specify which election would be held first, but Article 230 outlines the timeframes for those elections to be held; whereas the Egyptian interim President, Adly Mansour, has since called for presidential elections to take place first; whereas army chief Abdel Fatah al-Sisi declared that if the Egyptians ask for it he will run for president; whereas Abdel Fatah al-Sisi was promoted to field marshal on 27 January 2014 by interim President Mansour, and announced that he would run for president on the same day;
