Considers that the obligations in ACTA on the signatories to protect fundamental rights might not be sufficiently emphasised; is concerned that the ACTA text does not ensure a fair balance between the right to intellectual property and the freedom to conduct business, the right to protection of personal data and the freedom to receive or impart information, the requirement of which was recently ruled by the European Court of Justice; notes the concerns expressed by the European Data Protection Supervisor on the effects of ACTA on data privacy and is, therefore, concerned with the possible effects of implementing ACTA with regards to the Charter of Fundamental Rights of the European Union;

C. whereas the Commission has referred to the decision of the Ombudsman to justify that ACTA is negotiated as a trade agreement and not as an enforcement treaty; whereas the Ombudsman appraised that "the conclusion of the ACTA may indeed make it necessary for the EU to propose and enact legislation. In that case, the ACTA would constitute the sole or the major consideration underpinning that legislation, and citizens would have a clear interest in being informed about the ACTA"; whereas some governments consider ACTA will require changes in national law that increase the powers of the police to act on its own initiative to enforce intellectual property rights,

Beyond urging the committee to recommend a diminution or absorption of the air travellers security charge, ACTA believes that the broad-based economic prosperity of the country requires that members of this committee pay particular attention to the health of independent, small and medium-sized retail operations, such as travel agencies, and their ongoing capacity to serve Canadian consumers.
